AOS - EAD Form I-765 /Filing after 90 days of Entry

Hello! Hope everyone had a great holiday!

We are now ready to file for our AOS and read instructions for form I-765. On Item 6a on page 4, it states:

6. Family-Based Nonimmigrant Categores

A. K-1 Nonimmigrant Fiance(e) of U.S Citizen or K-2 Dependent --(a)(6). File Form I-765 if you are filing within 90 days from the

date of entry. This EAD cannot be renewed. Any EAD application other than for a replacement must be based on your pending

application for adjustment under ©(9).

Does this mean that we cannot use Form I-765? If so, what form should we be using?

11/05/10 - I129 Packet Sent

11/08/10 - NOA1

03/15/11 – Touched! NOA2!!!

4/4/11 - NOA2 APPROVED!

4/8/11 - Received NOA2 Hardcopy

4/11/11 - NVC received our case

4/13/11 - NVC mailed case to USEM

4/18/11 - Per DHL tracking, USEM received case

5/3/11 - Email sent to Manila IV Correspondence Unit inquiring about case

5/10/11 - We got our Philippine Passport!!!

5/11/11 - Received reply from Manila IV Correspondence Unit that they received approved petition from NVC and we are eligible to schedule a visa interview...Yippeeeee!

6/2-3/11 - Medical - WE PASSED!

6/14/11 - Interview - APPROVED!

6/15/11 - CFO Seminar

6/14 - 6/30 Now just waiting for our passports with VISA.

6/30 - Email received from USEM - VISA Issued

Now waiting for txt from 2go that VISA's ready to be picked up

AOS Journey:

1/24/12 - Mailed AOS packet to the Chicago Lockbox

1/25/12 - USCIS received packet

1/25/12 - NOA1

2/1/12 - USCIS confirmation receipt received via txt @ 2:46 pm!

2/6/12 - Received NOA letters

2/9/12 - Received Biometrics Appt Letter

2/27/12 - Biometrics Appointment

4/3/12 - EAD Received!

No, that is the right form. You file that along with the I-485. It's been a while since we did that form, but the status you file under is as an applicant for adjustment of status -- ( c ) (9)

Thanks for the reply....So, this is still the right form to use even if the k1 visa expired on 10/06/2011 and we are just applying our AOS now. So can we still apply for EAD?

It is the right form because you are filing with your I-485

Finally time for AOS.......

12/07/11 Sent AOS package

12/09/11 AOS package delivered

12/14/11 Received NOA for I-485 and I-765 (we're not applying for AP)

12/22/11 Received letter for Biometrics

01/04/12 Biometrics in Phoenix

01/31/12 Received email update from USCIS saying that we've been scheduled for an interview

02/03/12 Got an email saying card production had been ordered for my EAD...now just to wait for the card...

02/09/12 Received email saying EAD card has been sent

02/13/12 Received EAD card :D :D :D :D

03/06/12 Interview in Phoenix :).....Approved :D

03/14/12 Received Green card in mail.....

....no more USCIS until December 2013

Yes. As long as you file along with your adjustment of status. That saves you some money as well.

What you are reading is IF you file for EAD while on a K-1 visa AND not married as the EAD will expire when the I-94 does and given the processing times this is a waste of money. You use this form to file for EAD at the same time you file AOS as others have stated. Please keep in mind that this is a form drafted by our government to cover all possible situations which makes it confusing. If it was crystal clear, then they would not be doing their job now would they.:lol: .
