Ok...So I just sent her the link for her to read.She replied "You are not helping me,you are not a good person and so I refuse to listen to you.How thoughtful? I wish you would leave your friend alone, can't you see she dug a ditch and is about to fall in. I agree with her leave her alone don't even visit when she is deported.

She was asked to leave and didn't. If she is granted a green card then this whole bs that we have to go through isn't worth it.

Thank you all for your replies! I don't know her personally,I came across her on Facebook.I am totally against visa fraud,which is why I was so hard on her.There are a lot of things that I cannot mention on this site.She has done so many things that I totally disagree with.Everytime that I tried to talk to her about it she told me I am negative.I have thought about calling ICE,but I don't wanna be seen as a bad person.I tried to tell her to leave ,as she has been ordered to leave.It has been almost two years and she is still here.I'm gonna leave here alone because I don't want to be involved in any kind of fraud.Will I get in any kind of trouble if I don't/do contact ICE?? Gosh...I feel horrible. :help:

Sorry, but this sounds like she is marrying for immigration purposes....which is fraud. She has been married or attempted to marry three times in as many years?

I believe this is fraud and would say to her she needs to leave volutarily or be prepared to live here without documentation.

I agree it is fraud. I had two friends go through similar BUT it is a #######-shoot as to if they send her packing forceably. In this country from my understanding, once you're in they are not so quick to go after you if you are not causing any problems as with ICE they are more after the problem illegals. However as my friend's girlfriend is going through, she will always be illegal until the time he can afford an attorney and spend thousands on her AOS which can happen. Most know very well this woman in question will not leave knowing this. I have seen now 3 that over time the person gets their AOS using an Attorney. If she leaves she is out for good as she has over-stayed already. And having a child here they will not separate her child from her. Although I don't like what she did. I think she is better off just dropping it all for now and staying illegal. Sucks I know for all of us doing it the proper way. Thanks, Shawn

I can only say this is my second run at doing the fiancee Visa thing. My ex from 2007 came here ot USA even after I cancelled as it was a week before her interview we broke up. Somehow she slipped through and made it, believe it or not but it happened. When I foud out she was here I called ICE as I did not want anything under my name or responsibility. They took her name and even the address i knew she was staying but told me and I quote "sir unless she breaks laws, we are after about 10,000 or more criminals here that are illegal. She will not even be a blip on our radar but we will file it" So I say don't worry anymore about this and Good luck! Let her sink or swim on her own is my opinion... Yes I said earlier it is not right for all of us doing it legally. But not much in this world is fare for those that follow rules..... Thanks

Your "friend" is breaking the law. It is obvious she is just fishing for a GC. She is no "friend" and I suggest you report her for fraud. I would inform them of her removal order, her second marriage licence and her whereabouts. They will not approve her for a GC and she will deported with a sizable ban. They CAN and MIGHT deport her while pregnant so she doesn't give birth to a USC. In the event she gives birth before she's deported they will not order the child deported and the child will likely remain with it's father.

I agree with V&T wholeheartedly. Please be careful that this doesn't come back to bite YOU on the butt. You are aware of her illegal status, and that she may be collecting a benefit to which she is not entitled. To me, that's not worth risking being classed as an accomplice and classified as a non-desirable resident in the US. Even after citizenship you can fall foul of USCIS by aiding and abetting illegals.

You won't get into trouble for reporting her to ICE. Doubt they'll even know you knew about it it to get into trouble for knowing and not doing anything. If you don't want to call you don't have to. If she was a hard-working illegal, paying her taxes and staying out of trouble that's one thing - but she's claiming unemployment (I'm not sure how though), and marrying AGAIN to try and claim immigration benefits. Even if her husband was a USC I doubt they'd let her AOS based on the removal and obvious indicators of fraud (getting pregnant doesn't prove a loving relationship, just that she had sex and didn't use birth control).

If the child is born here it's a USC by birth. They will not deport a USC child but they will permit you to take the child of course unless there's no other options. Seeing the father of the child is here legally they would of course let the child remain here. It's more likely actually unless he lets her take the child she'll be deported without it.

Gosh, you are not a bad person and you should NOT feel horrible. my thoughts to you is to save yourself the grief and not worry about her. Don't call anyone, and just leave it alone. People like her almost always get what they deserve in life. I can't imagine how unjust it would be for her to get any immigration benefits, and it seems too unlikely! You should focus on you being happy and what's in your life and just let her go and forget about it. She doesn't even deserve the good advice you've already given her.

Yeah stop being unhelpful and negative and write her a letter explaining how much they are in love....and while you are at it be sure to fill up an I-864 for her. Her home country must be horrible if she is willing to use men up (and now a child) to stay here in the good ol' USA.

This might help because she was already ordered to leave the country they more then likely will not adjust for this marriage either. A guy I work with dated then married a Filipino who was ordered to leave (with out his knowledge and before his marriage). After she applied for adjustment again she received an interview then a letter stating she had to leave again long story short they hired an attorney spent close to 10 grand she is back in the Philippines and he is heart broke. He now plans to move there to be with her in 5 yrs when he can retire.

With all due respect to the OP, she may be blowing smoke. People notoriously lie on Facebook. If her circumstances are what she claims then there's zero chance she'll be able to adjust status. She's married to an LPR, so she'd have to wait until her priority date was current and she'd need lawful non-immigrant status at the time. Unlawful presence is not waived for family preference visa categories. Even if her husband became a US citizen, she married him after she was ordered removed, and they are required to presume that a marriage after removal proceedings have begun is a sham. Further, she was ordered removed because her previous marriage was determined to be a sham. There's is NO WAY they would accept ANY evidence she was able to produce that would convince them that this marriage wasn't also a sham.

Either her lawyer is guilty of outright lying to her, or she's fabricated a fantasy that makes it appear she'll be a lawful permanent resident sometime soon. I've known a few illegal immigrants who perpetually lived in the same fantasy world, and would get extremely upset if anyone tried to point out that there was no way they would ever get legal status without leaving the US first.

I see where a topic like this can bring out all sort of emotions. The fact of the matter is we all ain't USCIS so we should just state the facts and leave it at that. No one knows another person's situation so we shouldn't jump to conclusions and judge. I think that if she was order to leave then Immigration should have kept her after the interview and deport her themselves. I know of a case where the husband was trying to be mean and didn't attend the last interview they had set up. these people had been married for a while but were having problems. He didn't show and they denied the case. and she left. she wasn't ordered to leave or anything. she went home and continue working. Then her son filed for her soon after, of course with all that she had was to get a lawyer. Now she has been a LPR for two years before she divorced her husband. STOP BEING MEAN!!!:bonk: Who wants immigration to be called when they fall out of status?
