Above poverty level /or income requirement

until now we're still waiting for our NOA2 but time should not be wasted, so we are preparing documents and stuff for "hopefully" incoming interview..everything goes smoothly until i found out that my fiance's recent year income tax return fall below the required income. Income tax return total income year 2008 and 2009 are ok bec after retirement on 2006 he had worked as a part time worker in a company until last year..

he's been receiving..

8,940 from pension (tax already deducted)

9,500 from unemployment compensation

17,526 from social security benefits and

19,542 total income?????????? :( only

Why is this so???

HE have SSA form 1099- social security benefits statement and form 1099R from his retirement pension as a proof that he's been receiving the said amount annually. if we add this 2 income, the total income annually would be 26,466 and this is for life?!!and $3000 beyond required income for 3 person household, unemployment compensation not yet included.But the total income on 1040A really bothers me, is social security benefits not considered as income in 1040A ? bec this is written on 14a line on all ITR form. Does this would mean a red flag? or does the statements we have provided are enough proof to consider his income to be above poverty level?. Pls give me suggestion regarding this matter.. thank you so much!!!

Some forms of income are tax exempt and not shown on a tax return. It does not mean they are not income, they ARE income.

You are confusing the need to present a tax return with total income. Your income is what it is and what you can prove by attaching documents to that effect. Your tax return is a tax return, they are NOT the same thing necessarily.

On the I-134 state his annual GROSS income, before tax, and attach documents to prove it. Also attach last years tax return. The two things do NOT have to "match"

An income tax return can be misleading, taxable income is much different than gross income. Your gross income needs to meet the requirement as long as you have statements showing you exceed the requirement you are good, and it seems you have those.

thank you guys for all your thoughts and suggestions.. Yes i already have his 3 year income tax return, 1099s from pension and social security and i guess we will consider talking to his accountant so he can give us specific info and understanding regarding his income. GOOD LUCK TO US. :innocent:
