18 July '11: Only one Palestinian minor acquitted out of 835 charged with stone-throwing in past six years

New B'Tselem report reveals for the first time official data on treatment of Palestinian minors in Israeli military court system in the West Bank:

93% of all minors convicted of stone throwing were given jail sentences. This includes 19 children under age 14, who under domestic Israeli law could not be held in detention.

Israeli law, like laws in many other countries, affords minors suspected of criminal offences extra protections in the criminal justice process compared to adult suspects. In the West Bank, Israeli military law (applying only to Palestinians) provides very few such protections. Even after the establishment of the military youth court in 2010, minors are tried almost exactly like adults.

Among the relevant statistics presented in the report, which were provided by the IDF Spokesperson’s Office and relate to 2005-2010, are the following (all relate to minors charged solely with stone-throwing):

  • 835 Palestinian minors were tried in military courts in the West Bank on charges of stone throwing. Thirty-four of them were aged 12-13; 255 were 14-15; 546 were 16-17.
  • Only one minor was acquitted during that time (0.11 percent of the total), a conviction rate far higher than the extremely high conviction rate in Israel.
  • Of the 642 files where B'Tselem received details about the conclusion, 624 (97 percent) ended with a plea bargain; in only five of the cases (0.77%) was a full trial held. In Israel, about half of criminal cases are resolved in a plea bargain.
  • 19 minors aged 12-13 who were convicted of stone-throwing served a jail sentence ranging from a few days to two months. In Israel, it is forbidden to impose any prison sentence on a child under age 14.
  • 26% of the minors aged 14-15 and about 59% of minors between 16-17 served a jail sentence of four months or more.

Although stone-throwing by young adults and minors is an extremely common offence in the West Bank, no Israeli official was able to provide exact figures on the scope of the phenomenon and on the number of persons injured by the stone-throwing.

The infringement of the minors’ rights begins from the time of arrest and interrogation. Minors are often arrested in the middle of the night and taken to interrogation alone, without being allowed to consult with an attorney or even their parents, and without a parent being allowed to be present at the questioning. Often they are treated violently. The violation of their rights continues during the course of the court proceeding. Judges order the vast majority of minors to be held in custody until the end of the criminal proceedings, forcing plea bargains. This is because even if the minor is eventually acquitted, he will spend a longer period of time in custody during the course of a full trial than the length of punishment if he pleads guilty in a plea bargain. The military justice system views incarceration as the primary means for penalizing minors, and hardly considers other options. While incarcerated, the minors’ receive almost no family visits and face numerous restrictions on their ability to complete their studies.

All the official bodies involved are well aware of the reality described in the report. Yet, other than declarations by a few judges on the need to apply in these cases the principles of Israeli Youth law, and their expressions of discomfort with certain acts by the police or army, no action has been taken to end the infringement of the minors’ rights. The marginal changes made in the military legislation during the establishment of the youth court regarding the adjudication and treatment of minors, are woefully inadequate.

B'Tselem urges the authorities to amend, without delay, the military legislation to make it correspond to the provisions of Israel’s Youth Law. Additionally, the age of adulthood, currently defined under military law as age 16, must be changed to 18, as it is inside Israel.

Maybe they will learn one day not to throw rocks. By that time though I doubt there will be a West Bank and Gaza Strip. It will just be Israel. :)

as i recall there are no links to a printed on paper magazine i read in 2000.

i have sympathy for those who are human. when they dance in the street on 9/11 .....well it is a write off.

lots of people hate us Americans. but they sure do crave our freedoms and rights. rights that dont exist in the middle east. well except in Israel.

Any link for this story ? Because I can find no report of anything, anywhere, even resembling your account.

But apart from the complete dubiousness of your story, do you always form opinions of entire ethnic groups based on what you believe are the actions of one person, or one incident ?

If so, you must have no sympathy for anyone in the world.

All of the U.S. aid to the Palestinians (note: no quote marks) is part of Israel's welfare package - it's to pay off the PA for enforcing the occupation for Israel's benefit. Go Google which Israeli Prime Minister lobbied Obama to reinstate funding to the PA last month after the U.S. Congress voted to suspend it.

There are plenty of links to legitimate older articles online - from decades and decades ago, and the Palestinian-Israeli conflict is especially well-represented. If your little anecdote was actually reported anywhere, there would be a long trail of matches on the net for it, because any story that demonizes Palestinians (whether based in fact or not) is parroted endlessly on a myriad of pro-Zionist propaganda sites. Your story didn't even get picked up by PMW or MEMRI, who would be loath to miss out on a golden opportunity like this.

So unless you can find any evidence of this incident ever occurring, it seems your story is indeed apocryphal. But maybe you can email one of these well-known anti-Palestinian sites and give them all the info you know, and they can track it down for you.

I bet if it was 100 years ago, and someone showed you the Protocols of the Elders of Zion, you'd be a sucker for all that too.

Children of illegal settlers again in occupied Tel Rumeida, Hebron, West Bank - watch as they stone a Palestinian home as an adult settler stands nearby, while human rights workers plead for help through various channels to get Israeli soldiers to intervene.

To my knowledge, neither these children (who are very very young) nor the slightly older boys in the previous video from Hebron were subject to any disciplinary action, much less snatched off the street by police or soldiers, taken to a jail, and interrogated for hours without their parent present as would have been done with a Palestinian child

you are beating me up over a one page article i read 11 or 12 years ago and i have no idea what the magazine was, so therefor it doesnt/didnt exist and you cant find any link to it?

and the photos in the article were figments of my imagination? the article did not demonize anyone. i did that as my own opinion and my own free will and my freedom was exercised.

you chatise me for reading and viewing an article 12 years ago and now i have no idea what magazine it was in. sorry i did not think i would need that 15 letters of information 12 years later.i had bigger fish to fry.
