Risk of ravelling out of USA on about to expire OPT

Hi,

I completed my Masters and am working on OPT. The OPT is expiring January 31st. The thing is I have an emergency back home and I need to go back and return on the 22nd of January. Now my stream is eligible for STEM extension and I have applied for it but its processing and not approved yet. How risky is it for me to travel and can I be denied entry on the 22nd even though I have a week left for my OPT to expire?

OPT EAD card is not valid for re-entry! You need a visa to get in the US again.

Umm thats really not I asked. I have a valid visa till 2013. The OPT EAD card is valid for reentry if it is supported with your I-20, Employer pay stubs, Employer letter saying they granted you leave. I have rentered and left US multiple times on OPT status. What I want to know is the risk of travelling with my OPT card expiring on January 31st and the STEM extension pending(I have a valid visa but a visa alone is not enough for entry in the US).

Yes, there is a risk you'll be denied entry. It is a similar situation to that of a person traveling with a pending OPT application - your STEM has not been approved yet and you are planning to return very close to your EAD expiring. CBP can allow you back in, as you do have all the necessary documents - but they can also deny entry and send you packing. No way of knowing which way it will go besides trying. If you want to play it safe, don't travel until the STEM extension has been approved.

07/28/2011 - Day 147 - Post-Decision Activity Email from USCIS

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

("Resident since" date on the GC is 07/20/2011

Ahh thats what I thought I guess I should just play safe and not travel. Thanks a lot for your reply!!
