Hello,everyone!

My wife is a green card holder resident in NY, I came to NY on 2010/10/5 with F1 visa,now I'm overstayed for two months cause my wife is pregnant.But we already filed the I-130 (petition for relative) on 2010/11 and we received the I-130 Approval notice on 2011/11/02.After one month,we received letter from US NVC,it says I'm eligible for further processing,so I paid the AOS FEE and IV FEE. Later on I was told everthing I do and all the money I paid is useless cause the USIS think I'm in China,they sent my case to NVC and I'm overstayed which can not adjust my status.I went to attony that they told me only thing I can do is waiting for my wife to get her citizenship which she is not yet eligible.so what can I do?

Any advices I'll appreciate it!!!

usually the window on a bar/ban starts at 180 days on the overstay.

you've gone through NVC processing already, if you used EP then you have an appointment date coming up soon.

I dunno, you may want to look a bit over at immigrate2us.net - your situation is a bit skewed from norm, here at VJ.

Priority Date of F2A visa is 03/22/09, you have to wait at least 3 year (while you maintain your status) until a visa number is available for you or your wife becomes US citizen. Before 180 days pass, you have to leave the US to avoid re-entry ban, then you can wait for your visa number to be available and you can do the process properly.
