Dear All,

My wife and I would like your help on our case. My Wife is a USC and I am French. She moved to France in September on a visa delivered by French Consulate. We got married in October. Given her difficulty to find a job here, we are planning on going back to the US.

What is the fastest way for me to go back with her? We would like to avoid being separated again... At this point, she has not been in France 6 months so she cannot file for me right? Also if she does not get a job, this would be a problem when it comes to the affidavit of support...

What are our solutions?

Have the USCitizen Spouse file an I-130 petition for you.

She can file. She would not have been able to file DCF (directly via the embassy), but that is not an option since August 2011 anyway, she needs to send the petition to the Chicago Lockbox. The process takes about 8-10 months, and she can stay with you, but you will need a US based co-sponsor for the financial requirements.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
