So, My wife and I got married on July 31, 2011. I am a full time student, so after our honeymoon I had to come back home. We hired a lawyer to help us with our case. We have filed our I-130 on October 17, and got our NOA1 on October 22. My lawyer is on vacation, so I can't ask her the question. Do you guys know which visa she will be attempting to get after the I-130 is approved? Also, I am going back down to Colombia to visit my wife for 2 weeks in February.. Is there anything that I can do to help while there? Thanks.

Since youve been married less than 2 years, they will only issue your wife a green card thats good for two years, then around 90 days before it expires, she has to apply for removal of condition to get a 10 yr gc. This is the same process that my sister had and they didnt hired an atty at all. If you know your case no., you can check he status on uscis website. Goodluck! Im not an expert and this is based on my and my sister's experience.

Your lawyer filed out the correct form for you.. Pretty much the only option.. Hopefully that included good documentation for proof of your relationship - very few people get asked for additional proof at the interview so what they have now is probably all they are going to see. Still, I would still be working on proof of ongoing relationship (pictures and communication documentation) to take down to the interview.

The visa will allow her into the country where they will stamp (and initial) her passport to allow for travel outside the country for one year. Well before that one year she will get the green card in the mail. Because you have been married less than two years it will be "conditional" which means more forms and money at the 2 year (minutes 90 days) mark.. She will then be a resident with a 10 year green card.

From your timeline it looks like she could be here by early to mid summer if there are no problems.. Good time to make the move :)

If your lawyer suggest filing an I-129F after the I-130, she's not serving you well. That doesn't means she doesn't know what she's doing. It would mean she knows she can charge a higher fee for two petitions than for one, even if the second is useless and will delay the eventual CR1 visa. No K3 can be expected at this time or anytime in at least the past two years.

Facts are cheap...knowing how to use them is precious...

CR1 as explain before

1)Stamp in Colombian passapor at POE or port of entry

2)2 year Conditional Residensy Wish is the Definition on CR Removal of conditions start

90 days before expiration form 751

3)your NOA1 have a case number that can be follow on USICS to se the famous dots of process

4)You can go and put together all evidence of relationship

a) Weading declaration Plus transalation in english must be certify

b) her birth certificate also translated

(some Vj's may say that you dont need this again however there is stories of missing

papers during the 5 step process all the way to Embassy in BGT)

c) Photos

d) Airplane Ticks

e) I 864 w . financial info and CO esponsors if needed

Have a safe trip to Colombia and take as many pics as you can for your file . IM SORRY Unless you are on first name base w. the president or the Clintons there is nothing else you can do to make the process go faster . I understand your pain as we all had gone in the same road.

all depends on NVC action, or lack of NVC action. Pay attention to what's what, at NVC, after BOTH petitions are approved.
