That seems very odd then. I have no clue as to why his visa doesn't have a 6 month expiry like it should. Personally, I wouldn't worry about it as long as he's planning on entering before the visa expires. I would be worried that giving the visa back to Casa to make changes might trigger more delays.

I agree as long as he's gonna make it here for Thanksgiving then don't worry about it, just walk away!

But if Simo comes 1 dsy before his visa expires would he be out of status if they were to marry 1 day after his visa expiration? Carrie, I probably would not take any chances by going back to Casa to get anything change. Simo will just have to have an incomplete project in order for him to get here before the visa expires.

This may also affect him as far as getting a "Temp Work Permit" from the POE.

But I thought we were supposed to get 6 months from the issue date to enter the US and then 90 days from the date of entry to marry and adjust status. If this is not the case, then we are screwed because there is NO WAY he can get here, us get married and file adjustment in the next 7 weeks. :huh:

The 90 day count starts from your entry. Once you use the K1 visa to enter, it basically becomes void, so the expiration date is irrelevant as long as you enter the U.S. before it.

The concern I have is the I-94 being valid for 90 days because his visa will have expired before the 90 days after entry. I dont think the I-94 will be valid past the visa expiration date. Carrie knows I am not trying to scare her but I just want to make sure everything will be okay on this end.

The I-94 will be valid past the expiry of the visa. It valid for 90 days from entry, regardless of the expiry of the visa.
