Our experience was at 7 months, this was after the petition was tranferred 3 times. I feel your frustration but I was told the 5 month is an approximate guideline not a timeline set in stone. Hope you all get your NOA2 soon...

And they've made that more than clear. They've also made it clear, without ever actually saying it, that the 'standard processing time' is whatever they say it is with no oversight of any kind.

Unsure. Though if they've shifted adjudicators from I-130s to I-129Fs it would certainly explain why the I-130 processing volume fell off, no?

This is really making me angry. I was told they put a service inquiry through today. I do not think it ill trigger any kind of "touch" or any kind of "NOA2". If it triggers a "RFE" that would even feel good right now. I just want somebody on my case!

does anyone know what time to expect an answer? I mean is it usually within their business hours or can the reply come say at a weird time like midnight?

Also, how much time to expect the NVC to take? what exactly does the NVC do with the I130 petitions when it receives them?

There has to be a way to speed things up... and I'm not talking about expediting... I mean, can't we write to the USCIS headquarters or something. Can't someone in authority move things forward?

They need to come up with a way to speed up the process. There must be an easier way..it's the USA!!!However, five months is already a long time to wait on an approval, so I can understand why people would be impatient,anxious or upset once this period has passed. Perhaps they may need to change the turnaround time to 6-7 months or hire more staff. Excuses such as they are "backed-up" is unacceptable. This is a 'service' that they are offering and certainly not 'free' for the petitioners.

While your thoughts are noble and I wish it were possible, there seems to be nothing we can do. I admit this is my first, and Lord send only, dealings with a truly faceless and unaccountable bureaucracy. In any other dealings I've ever had with the government there was at least someone to call and go see. That you could talk to and find out something useful.

In this case, there is not. The entire process is controlled by people that seemingly don't care in the slightest that they hold people's lives in their hands. We're merely numbers and paper to shuffle.

Are there people in this leviathan that care? Probably. Do I have any reason to believe they are even close to the majority? No.

As I understand it their main function for an I-130 is some paper work intake (you have all that ready to go, right? ), verification, some stuff that USCIS also does, fee collection, and appointment scheduling.

As to how long it takes, just like USCIS it varies all over the place. I would expect it to take a solid two months from exit USCIS to exit NVC. That is to say interview date in hand. Expect that and hope for less. Some places take longer as the longest delay is often getting the interview date and that is dependent on how busy the consulate/embassy in question is.

Have you contacted the USCIS by telephone to check your status? They have been saying for at least a month now that they are working applications from 6/15. I would also suggest contacting your Congressman's office and have their Immigration liason do an inquiry for you.

BTW, i'm sure you are 'thrilled' when you see that the last 3 reported NOA2s were from VJers who filed in December.

It seems to me that it makes sense to apply for K-3 IMMEDIATELY when receiving the NOA1 just in case there is a delay in processing the I-130. You know... just for backup.

If you were to submit an I-129F in conjunction with an I-130 to start the K3 process, your I-130 would be pulled from its place in the queue and placed with the I-129F that was just submitted. Since 2006, USCIS has been tying the two petitions together and adjudicating them at the same time. Filing an I-129F to start the K3 process as a "backup in case there is a delay in processing the I-130" would not work because the two petitions are tied together.

It is my understanding that K3 visas haven't been issued for a year or two because the processing time for the K3 and IR-1/CR-1 are about the same these days. When the K3 visa was created couples were waiting 1-2 years in some cases for their IR-1/CR-1 visas to be issued.

What I don't understand is why it would take USCIS longer to process an I-130 application vs an 129-f application. Maybe a less rigorous background check?
