Hello, Im glad i found this website while trying to research what needs to be done for our family. Ill start by explaining our situation and hopefully someone can help because we are really unsure where to go from here.

Situation :

I am from the UK my wife Teri is from the States, We have 3 kids 1 is my step daughter US and my other Daughter was born in the US While i was on a Visitor visa wavier and my Son was born in the UK while Teri was here on a Marriage Visa to the UK.

We got married in 2007 in the UK our Son was born here and we got him his US Citizenship done at the US Embassy in London.

We recently went back to the US i went on a visa wavier again just to help her move with all our bags since i lost my job in the UK When the rescission came, Anyways we spent 3 months together in the States i came back as my visitor visa ran out. i then tried to go back again to visit them around 2 - 3 months later and they denied me entry due to "intent to stay" As i only just went back and now im trying to visit again the main reason was it was my daughters birthday but they didn't want to see it that way.

So now were trying to do it properly but unsure what visa i need to apply for to get to the States with our situation.

I believe its the I-130, Is it possible to do a DCF In london since i am here but my Wife is in the states ?

What kind of time length are we preparing for,

We have read 2 - 3 months and also upto 8 - 10 months.

Any Experience and help would be greatly appreciated as we want to make sure we apply for the best and fastest visa to get our family back together soon.

DCF is out as your wife is now resident in the USA; only when the USC has been legally resident abroad for 6 months immediately prior to filing can you file DCF. So, she would need to petition for you via the Chicago lockbox. 8-10 months sounds about right.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
