Happy New Year everyone,

I entered the U.S. on B1 visa on Dec 2nd 2010, I got married and filed for J2 on Mar 29 2011, I-94 expired on Jun 1st 2011.

I filed an SIV petition(based on Iraqi interpreter worked for the US government) on Jul 11 2011 and got approved Jul 19 2011.

I filed for a green card on Aug 11 2011, my J2 I-539 application was still pending at that time. Biometrics done in Sept 2011.

I received RFE for my J2 on Aug 26 2011 after I filed for my green card. I abandoned the J2 application because it will put me under the 2-year home country residency requirement and I did not respond to the RFE.

I recently received a notice to appear for an AOS interview.

My questions are:

1. Will the IO forgive my B1 visa overstay?

2. I don't have my original I-94 currently available with me (filed the original in a waiver application for my wife), does it have a bad effect on my interview?
