Hi, my divorce in is 2 days but I just heard that he is waiting to divorce me then get me deported. I have my 2 year conditional green card it expires May 12, 2012. I am so scared. I was wondering should I make a statement in the marriage agreement that he cannot intefer with my green card? can he get me deported? I am originally from Canada. Thank You

Sorry but you already have your green card.

He is fear mongering you and you should NOT let him. He cannot have you deported and he cannot take your green card. Its yours.

When your divorce is complete you need to file for removal of conditions ASAP to get your 10 year green card should you choose to stay in the USA.

Your I-129f was approved in 5 days from your NOA1 date.

There is no way he can get you deported!!! So dont worry about that! Once the divorce is final and you have the decree in hand, you can go immediately to apply for the Removal of Conditions - Waiver, based on divorce. You do not need him to complete this ...BUT you must have all the proof that the marriage was entered into good faith and documents which show co-mingling from rhe tine you married till now. As you will be submitting the I-751 by yourself, you will most likely need to have an interview too and that will be your opportunity to explain anything you need to the IO. You'll be just fine!! Just get all your evidence together and come find us other ROC folks in the ROC forum...!

04/05/17... Paid the $120 Immigrant Visa Application Processing Fee online today (Also eligible to pay the $325 Fee but will wait before doing so...)

April-August... Took a break from the process in order to move back from USVI to mainland USA.

08/07/17... Paid the IV Fees for both my parents ($325 each) today

08/23/17... Called NVC because payment still showing "In Process", was advised to email proof of payment to have them manually correct it

08/24/17... CEAC website shows "Paid" and can now have parents' DS-260 forms filled in.

No he cannot "get you deported" but he can tell them that he thinks you married him for the GC. They'll only listen if he has proof.

No your divorce papers can't say he can't "interfere with your GC". It's irrelevant to the divorce process for one, and secondly if you didn't marry him for the GC you have nothing to worry about. Writing that in the divorce papers makes you look guilty.

Agreed with Vanessa&Tony. Presumably you did not marry him for a green card, so he won't have any proof to try to use that with USCIS. It sounds like he is just trying to scare you. Once your divorce is finalized, your best bet is to cut him out of your life and move on. You need to file ROC immediately after it is finalized, and then you'll have your 10-year green card.
