Hello,

I was referred to this site by a good friend I don't know if I am putting this story in the right forum I hope so.

I am here in the US and I am engaged to a man from Cameroon he came here 5 years ago on a visiting visa and overstayed his visa so yes he has been here illegally. We have been together 6 months and are in love and planning to marry.

Then all hell broke loose he got into some trouble and was arrested. He has never been in any kind of trouble before.

His daughter who is 5 years came to visit from Paris on Christmas he left her with a babysitter to go to work the babysitter then left the child alone when my fiance returned to pick his daughter up he called the police because he couldn't find anyone and he was arrested for child neglect. The babysitter denies being responsible for the child.

This story is very long and complicated but that is the gist of it for you guys to help me any way you can!!

He is now in jail without bond and they now have found out he is here illegally so he will most likely get deported.

my question is can a lawyer stop deportation and get him a bond? If he does get deported and I go to cameroon to marry him will he ever be able to come back to the US or any other country?

It sounds like you will need an immigration lawyer who deals with deportation waivers. It would seem to me that his lengthy overstay would cause a deportation order that would probably mean a 10 year ban. If you were to marry and file for an IR-1/CR-1 he would need to file form I-212 for a deportation waiver (I think). No matter what the case he needs representation now.

Get a lawyer NOW, and try to get the judge to allow you'll to marry and AOS within the US. But you will need a good lawyer and about $6,000.00 to $10,000 for this process. If he is deported you will still need the same amont of money just for lawyer fee, and about 10 years without him being in the US.

THIS WILL NOT BE A EASY ROAD TO WALK.

If he goes to court w/o a lawyer then he needs to self deport himself at the most.

BTW how did a 5 yeAR OLD COME TO THE US TO VISIT WITHOUT AN ADULT......(DON'T ANSWER).

Seems like a lawyer is in order here.

But my comment goes into the neglect charges. A parent very rarely gets arrested for just neglect, at least not in Texas and I would think laws are similar in all states. There might be more to the story, which might include a warrant for arrest for another reason. Make sure you get the complete story which your attorney must know if he is to defend the case with success.
