Tax Transcripts for N-400 'unavailable'

Hello!

I'm having no luck obtaining my tax transcripts through the IRS's automated system. I've filed jointly with my wife for the past three years and I was able to order her's through the system, but all of mine were 'unavailable'. I filed as 'single' before we were married in 2007, and that transcript was available. Would the 'joint' status be affecting this? My name was listed second on the returns under her name. Is its unavailability a red flag for: 'you haven't filed your taxes?'. That's my main concern, although our tax return copies have my name listed w/ SSN as "joint".

There's a local IRS office in my city. Does anyone know if I'm able to drop in to inquire? Or should I not worry as I was able to obtain my wife's transcripts?

You have filed your taxes, you filed joint taxes with your wife.

You provide the joint tax returns. They are BOTH of yours not only your wifes.

Joint returns are for both of you. I'm not sure why you want ones from 2007 though. They're not needed for financial reasons, just to show co-mingling and stuff so the ones with you filing joint are all you need.

If you file today, tax returns for 2008, 2009, and 2010 is all you need, next month, may have to add a year to each of those returns or may want to see your 2011 returns during your interview.

Since I am a male chauvinist pig, my name is on top of our joint returns, so had to use my name to get joint returns for my immigrant wife. Really, the only thing the USCIS wants to see are both your names on the same return.

Is an exception however, if you filed married but separately, then would have to bring in both returns. In our case as well as many others, will end up paying more taxes that way as many deductions are not available when filing separately.

If both of you filed single separately while married, would be in deep trouble, not only with the USCIS, but with the IRS as well. Our income tax system is the most complicated than anywhere else in the world with over a thousand different forms. I grew up with it, but certainly can see the confusion for a person new to this country. My wife really has to trust me since she also has to sign those papers. Only hear about tax reform during an election, then a dead issue. Keeps on getting more complicated with over 13,000 pages on tax laws.

What happens if I filed separately? Would that cause any trouble for me at the interview? I had to do that, since my husband hasn't filed in a few years, his situation is more complicated, and we decided it was best for me to file as married, but filing separately. And of course I don't have any kind of copies of tax returns from him. Could that be a problem?

Wow, that's a very determined YES there... Why do you think that would be such a big problem? I didn't file as single, but as married... separately. I'm sure we're not the only people in this situation. It doesn't mean we're separated, or anything like that, we just decided it would be for the best, considering his tax situation.

I would not say there is definitely a problem. When married, there are two categories to file under, married filing jointly or married filing separately. You have complied with the law by filing under either one of them. The question that may arise is why did you file married filing separately and you can explain to the IO why you filed that way. Being married and filing separately is perfectly legal with the IRS, for the USCIS, have to bring in both returns to prove you are living at the same address.

If only one spouse is working, would be foolish to file separately with the other not filing at all, first off your spouse is and exemption worth $3,650.00 in additional deductions you don't pay taxes on. If using a standard deduction with a joint return, get to deduct an additional $12,500.00, but if filing separately, can only deduct half of that. So by not filing jointly, paying taxes on an additional $9,900.00!

If my wife and I filed separately, we could not deduct an additional $4,000 for her daughters college tuition, with that deduction, more money in our pockets, less in for the IRS, but they make the laws. That $4,000 is a bad joke on us, paying more like $10,000.00, but only to deduct $4,000.00 of it.

Further deductions are available filing if you also have to pay state income tax.

I do our taxes filing both singly and jointly, far better off for us to file jointly. And definitely claim her as an exemption when she wasn't working. But even if we did come out ahead filing singly when she was working, would still file jointly to keep the USCIS happy. But never had reason to filing singly, we would as a family pay a lot more in taxes.

We have other ways to prove we live at the same address. We have the lease in both names, bills in both names, joint bank account, both out IDs have the same address, and probably several other things that we have included in the package, that I can't remember at the moment :)... My husband's tax situation is complicated and it goes way back years ago when we weren't even together, so he suggested that I file my taxes married, filing separately so I wouldn't get affected by his problems. When I filed for the removal of conditions I didn't even send any tax information whatsoever, because I wasn't working yet and he... doesn't have any. I can explain the situation at the interview, and I don't really see why they would give me a hard time over something that's technically out of my control. Or maybe that's just wishful thinking...
