NVC Filers - January 2012

As NVC will not ask 2011 tax, we will not have to show them tax transcript os 2011 but 2010. Now once NVC scedule us anm interview and i go to the interview, i am sure that the officer will ask tax 2011. Now as NVC did not request from my wife 2011, i will have her fill the I-864, her and the co sponsor. NVC will not have time to review this document as they did not ask it. but the officer will at the embassy by asking 2011. ( already filled by co sponsor and petionner . Will the officer take time to review it by a simple look on the day of the interview. do you see where i am coming from?

Maybe I'm confused by what you're saying, but you HAVE to send to NVC the I-864 forms and 2010 tax information. The ONLY thing you don't need to send to NVC is 2011 tax information.

Then, for the interview, bring 2011 tax information, of both the petitioner AND co-sponsor.

No, because the I-864 they both submitted at NVC will be sent (with all other documents) to the embassy. They just need to bring the 2011 tax information.

That's what I did. I got to NVC at the end of January. Since my husband hadn't filed his 2010 taxes, he completed the I-864 and sent in 2007, 2008, and 2009 tax information. Once I had my interview at the beginning of April, my husband had filed his 2010 taxes, and I brought the 2010 tax transcript with me and handed it to the officer collecting documents.

you think they might request it even though we got an interview in march?

Manila Consulate starts asking for 2011 tax during interviews these past few weeks, but if the petitioner or joint sponsor hasn't filing the tax yet... Then they ask for the 2011 w2s instead...

You DON'T submit 2011 information if you don't have it. I never said you submit 2011 tax information to NVC.

I think I see what you're saying, and I think you are on track. You will send your wife's I-864 and 2008, 09, and 10 tax transcripts to the NVC. To the interview, you will bring your wife's 2011 tax info, the joint sponsor's tax info for 2009-11, and the joint sponsor's I-864. At least, that's how I understand it to work (but don't take my word for it!)

u got it right! that is what i meant. now i want to know as we will not fill the I-864 with a co sponsor as my wife will not need one for 2008,2009,2010 tax transcript,will we have to have the co sponsor fill the I-864 anyways with his tax transcript, keep them( not to send it to nvc ) in hands for the day of the interview

I think I see what you're saying, and I think you are on track. You will send your wife's I-864 and 2008, 09, and 10 tax transcripts to the NVC. You've got everything right EXCEPT the co-sponsor will send the I-864 and 2008, 2009, 2010 tax information to NVC as well as the petitioner. If the joint sponsor does NOT send their information to NVC, then an RFE will be issued as the poverty guideline has NOT been met by the petitioner.

The ONLY thing that has to be brought to the interview is 2011 tax information from both the petitioner and joint sponsor.

Ok, Rujby, I'm going to outline this as basic as I can.

What to send to NVC:

-Petitioner's I-864

-Petitioner's 2008, 2009, 2010 tax information

-Joint sponsor's I-864

-Joint sponsor's 2008, 2009, 2010 tax information

What to bring to the interview:

-Petitioner's 2011 tax information

-Joint sponsor's 2011 tax information

Well, if she meets the poverty guideline with her 2010 taxes, then there won't be an RFE. In 2009 and 2010, she made enough for a household of 4. It's just the last year that she didn't make enough. From what Rujby is saying, it seems like they don't plan to write the 2011 taxable income on the 864...although now that I think about it, there is a place for CURRENT annual income...which might trigger the RFE anyway.

I've seen other people claiming they were able to submit cosponsor info at the interview, because it wasn't officially needed, but they had it for backup. I just don't know if that's true or not.

in 2010 her household size was 3, she just add her sister as dependent this January 2012, just to earn more money in the tax return, that what complicate everything. 2010 her household size was 3 and she made $28K

Yeah, but they only ask about her current household size, so she won't be able to say she has a household of 3.
