Hello everyone. How are you? Happy New Year! Ok so you know when you receive your visa, then cross the border and they give you like a I-94 form? Ok well that form is usually used for when you have a limit to stay in a Country. Well this time it was made/given to limit the time you have to get married, ect. But as its used for the 1st option and when you get back in your country you give it to the officer there, but this time around, there isnt that option, so who do you send it to? Do you mail it to the border, where I crossed? I crossed into Plattsburgh, New York. Bordering with Canada, Quebec.

You keep it. It is needed for filing AOS. If you have an AOS interview, they may take it at that time. Otherwise, you have a keepsake.

It is not JUST for a marriage countdown. It works the same as any other I-94, and you can accrue overstay when the I-94 expires. However, when you file for AOS, you enter a period of authorized stay and any overstay time will be forgiven when your AOS is approved.

You keep it. It is needed for filing AOS. If you have an AOS interview, they may take it at that time. Otherwise, you have a keepsake.

It is not JUST for a marriage countdown. It works the same as any other I-94, and you can accrue overstay when the I-94 expires. However, when you file for AOS, you enter a period of authorized stay and any overstay time will be forgiven when your AOS is approved.

But the girl at the border, which didn't know really know anything, because I asked what to do with it, and she said, send it or ask whoever you are doing your AOS with, so I keep it? I don't send the original and make a copy and keep that? Ok so the whole I-94 is just so I do all the AOS steps under that period of time and they make sure I do, because they record it and are the ones who planned it?

You send a copy. You bring the original with you if you have an interview.

So I do send it? To whom the border where I crossed? How do I find the address? I know there is a site for homeland security I don't remember now. Im confused.

No, you send it with your AOS application. The information is all in the instructions.

Keep your I-94 for your interview. Send a photo copy of it with your application. If you have an interview for your AOS, the AO may ask for the I-94, and your EAD/AP, and destroy them. He/she may not. Our AO punched holes in ours, and attached those to our file. Another friend went for an interview with a rookie AO, and he didn't even ask to see it, or the EAD.

dont rely on CBP to give you accurate USCIS information. VJers often know the process better the the border official.

hang on to everything. makes copies of everything. read instructions thoroughly. submit orginals when required, copies when not.

start learning the AOS process so you can gather the materials as you accumulate them.

Always send copies except your sealed medical envelope for AOS and entering the us. make sure you do no loose your I94 it is a little card stapled in your passport.

It took a few readings but I *think* the OP is saying that usually when you get an i-94 it tells you how long you're allowed to stay, and you return it when you go back to your home country and it proves you didn't overstay. THIS time though they're not returning to their home country before the deadline on the I-94 and the deadline isn't a "time to leave" so much as a deadline to marry (though it's actually both) and they're wondering what they're supposed to do with it.

OP. You keep the I-94. Leave it stapled in your passport. You can take it out to photocopy the front and back of it to send with your AOS application and then re-staple it back in. If you have an AOS interview (not all K1's do) they will take the ORIGINAL at the interview. If you're approved without and interview it remains in your passport and you can just hand it over the next time you leave the country (if you like) or don't.

You're over-thinking the I-94's purpose. The I-94 is the same as any other I-94, the only difference is entering on a K1 visa gives you 90 days of legal presence (B1's can be 6 months etc the I-94 from the K1 HAS to be 90 days). That 90 days on the I-94 helps you know when you need to marry by. If you don't marry by then you should leave before that date to not accrue legal presence. If you marry AFTER that date you need to file an I-130 because you can't AOS from the K1 visa unless you marry in those 90 days.

In short - leave it. Read the instructions for AOS and everything will appear clearer (there's an AOS thread in my signature that should help too).

Once you enter the US with a K-1, the K-1 is null and void. The I-94 takes its place. You must get married within the 90 days to satisfy the terms of the K-1, but there is no time limit to file AOS. It is suggested you file for AOS within the 90 days or as soon after your I-94 expires as you can because you begin to accrue overstay days after the I-94 expires. Filing for and having a pending AOS puts you in a period of authorized stay.

You do not send it back to the border where you crossed. You must send a copy of your I-94 with your I-485 when filing for AOS. Keep the original in your passport where they put it. If you are given an interview (it is a 50/50 chance), then bring your passport with the original I-94 with you to your interview. They may, or may not, take the I-94 from you at that time.

Also, you cannot leave the US once you enter with a K-1 until you get AP(applied for with your AOS), or receive your green card.
