Hi

I am the wife of an American citicen, an we have an i130 in prosess. It has been 5 moths now, and my status is still Initial Review at the USCIS site. I am in Norway waiting to be approved so I can go back to him. We have a two month old son who has been registered at the US Embassy, and he is now an US citizen.

I tried to apply for a tourist Visa, but they did not want to give me one due to the fact that I have spent a lot of time in the US the last couple of years, and I have overstayed my welcome with 1 day twice (I had an ESTA, and you can stay for 90 days)

We are getting tired of waiting, and are hoping to be able to start our life as a family soon.

We just heard about the K3/4, but are not sure if this will help us.

Perhaps someone here can advice us on what to do?

I am no expert, but at this point, it is better to leave things as they are. I know it is difficult waiting for your life to begin, but we all had to do it. Do not apply for a different visa. Perhaps your overstays are creating a delay, and perhaps it is simply because of the amount of visas that USCIS has received.

since you guys already have the IR in rpocess, the K3 will not do much at this point( IMO)... hopefully you get some good progress soon. It seems a lot of people are in the same boat. With the new year and everyone back in the business mode I hope to see more fast paced processing.

USCIS stage ( 66 days)
10/12/2012: NOA 1
12/17/2012: NOA 2 (case was transferred to NYC office 11/27/12)
NVC stage ( 20 days)
01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)
01/09/2013: AOS invoiced and paid, DS-3032 emailed and mailed.
01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

01/28/2013: Case complete!!!
04/19/2013: Interview; APPROVED!!!!!
05/13/2013: POE; JFK


N-400: (3 months and 12 days)
Filed N-400 : 2011-06-17
Interview: 2011-09-27
Oath Ceremony: 2011-09-30

IR-5 for Mom Entire process took 5 months exactly
USCIS (22days)

mailed I-130 : 2011-09-30
NOA 1: 2011-10-03 (text & email)
NOA 2: 2011-10-25 (text and email)
NVC: (19 days)
Case entered and # assigned: 2011-11-18
NVC Case COMPLETED: 2011-12-07 ( 43 days from NOA 2 and 65 days from NOA 1)
Interview Date(Lagos): 2012-01- 23
Mom was late for interview
New Interview date: 2012-02-29 : VISA APPROVED
