Check out the "Frequently Asked Questions About the K-1 Fiancé(e) Visa" on the U.S. Embassy Manila's website. It says the following:

How much time is given to complete the K-1 visa application?

A K-1 petition is valid for four months from the date of its approval. But this may be revalidated by a consular officer provided that both parties are still legally free to marry. It is recommended to gather all the necessary documents for the visa interview appointment as soon as possible.

U.S. Embassy Manila link.

Also, I can't find the link, but I've read elsewhere that the Embassy will revalidate an I-129F petition two times. Counting the original four-month validity, two extensions would make the petition valid for a total of one year.

Just make sure you request the extensions from the Embassy. Let them know that you want an extension, that you are still legally free marry, and that you still intend to get married.

Happy New Year! :star:

When my i129f petition was approved in a month, we were unprepared and i could not leave my job that soon so i called usem to ask if i could extend my noa2 for a month and they told me that i had a yr to schedule my interview :)

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Thank you, VJ! smile.png

Hello VJ's,

I am so sad right now :(( We found out just this January 03 that the petition for divorce recognition of me and my ex had dismissed said because of insufficient evidence. What makes me upset was it was dismissed September 23, 2011 and if we are informed immediately it won't take this long :( Maybe the required documents to be submitted would be done... I hope the government sometimes do their job as it is. Now the only thing they need is the civil code authenticated from the Philippine consulate in Chicago to make my petition terminated. They are only giving us until the 18th to appeal. I am so scared because our I-129F will expire March 28 and I hope before that the decision will be submitted so that i can get record from NSO... I was so disappointed because I always follow up our case and they said no decision yet but then we found out it was dismissed 3 months ago :((.

So all I can right now is pray and I m sure my fiance is frustrated already from waiting! I wish my ex feed those Atty.s!!!

Short version answer...,

There is no divorce in PI. BUT...(Article 26 of PI family code) If a Filipino marries a foreigner and (later) the foreigner spouse divorces the Filipino...the Filipino may ask the PI court to recognize the divorce and when /if divorce is recognized ...the Filipino is free to marry again. (Divorce must be initiated by the foreigner spouse)

Another and potentially bigger problem (for the op)...filed petition b4 PI court recognized divorce...ouch.
