Woke up in the middle of the night with a cold sweat. That's when I realized I may have made a mistake on my husband's AOS application that I had sent in the other day. I had mailed in two separate checks: one for the application and one for the biometrics fee. The application check was a $985 cashiers check through my bank while the $85 biometrics fee I paid through a CVS money order. #######. I, for whatever reason, forgot that the checks/money orders had to be through banks or government institutions.

...To make things worse, I just looked at the USPS # I had for the parcel and it says:

Notice Left (Business Closed)

I can't comment on the money situation but you should be fine with the delivery. I had the same message from usps when Travis sent our I-129F in March. It just means that nobody was there to sign for it. The next time someone goes to collect the mail it will get signed for and picked up

Finally time for AOS.......

12/07/11 Sent AOS package

12/09/11 AOS package delivered

12/14/11 Received NOA for I-485 and I-765 (we're not applying for AP)

12/22/11 Received letter for Biometrics

01/04/12 Biometrics in Phoenix

01/31/12 Received email update from USCIS saying that we've been scheduled for an interview

02/03/12 Got an email saying card production had been ordered for my EAD...now just to wait for the card...

02/09/12 Received email saying EAD card has been sent

02/13/12 Received EAD card :D :D :D :D

03/06/12 Interview in Phoenix :).....Approved :D

03/14/12 Received Green card in mail.....

....no more USCIS until December 2013

You may be ok. Money orders are accepted as long as the M.O. are drawn on US banks. Here is the link from the USCIS............

What do you mean that his K-1 visa just expired? It's been years for us, but if I remember correctly, the only things with a deadline you have to do are use the visa within a certain amount of time (6 months?) and get married within 90 days of his arrival. It's recommended to file for AOS as soon as possible, but there's no actual deadline. Check with others to make sure I'm right. That should give you one less thing to worry about!

His visa did not expire. His visa was CANCELLED when he stepped off the plane. It was replaced by the I-94. If you were married before the I-94 expired you are fine. There is no particular deadline to file AOS

Worse case? The package gets returned and you send it out again. Slight delay.

What do you mean that his K-1 visa just expired? It's been years for us, but if I remember correctly, the only things with a deadline you have to do are use the visa within a certain amount of time (6 months?) and get married within 90 days of his arrival. It's recommended to file for AOS as soon as possible, but there's no actual deadline. Check with others to make sure I'm right. That should give you one less thing to worry about!

You are right. Worse case this is a several day delay in the green card, nothing more.

The money order is fine. Not sure about the address.

You are definitely fine on the money order. The CSV money order is aso drawn from a US bank (CVS just sell it) and it indicates which bank on the paper.

You are also probably fine on the address too. The Business Closed status happens sometmes over the weekend/holidays. They will probably try it again and the docs will be signed for.

As we tell everyone here on VJ, the K-1 visa "expired" the monent the holder entered the USA using it. The expiry date on the K-1 is its validity period for entering the USA. You MUST enter before that date. Once you enter you them have 90 days to get married. Once you do that you have no deadline to file AOS. Most will recomment you do it ASAP and they has been a very heated discussion on what happend if you wait until after you second wedding anniversary to file. Other than that I would just wit to see what happens. If you get them back, correct the error and resend them. If yoiu get your NOA then ou are on your way.

Good luck and relax this is the better part of the journey as you are now together.

You'll be fine. Delays over the holidays are to be expected. Get ready for another federal holiday on January 16 too. The only concern that you really have now is having filed before the medical screening was too old, but from the sound of it, that's not an issue at all, so just give it a little more time.

By the way I lived in Tajikistan for a year and a half and worked at the US Embassy there. I sure miss the place!

02-08-2012 - EAD/AP card received.

02-21-2012 - AOS interview approved. EAD/AP card confiscated.

03-01-2012 - Green Card in hand!!!
