How to update your marital stauts, when your I130 hasn't been approved yet?

Hi everyone,

I got married overseas, and I am a US citizen, My I 130 still not approved, my question how do we update our marital status? Wouldn't they ask for a prove that i am married? and if so if the i130 hasn't been approved yet, should i update my marital status?

I need your help.

If you filed out I-130 then you sent your marriage cert with it.

Who do you want to know that you are married?

Sometimes the overseas person can change their passport to show married.

If you changed your last name to his then you can change your passport and other documents and bills.

Maybe I'm reading this all wrong - but are you asking how do you let USCIS know that you are married? If you filed an I-130 - you should have already been married and would have needed to have sent a copy of your marriage certificate with your petition.

I read it the way you read it but also see it as the OP asking how does he prove hes married if the I-130 isn't approved..

OP the I-130 does not prove you are married, your marriage certificate proves you are married.

OP, what visa are you applying for? Are you being petitioned by a relative (say, your father or sister) and recently got married? Or did you come to the USA on a K1 fiance visa and now got married?

Thanks for all the replies, sorry if i was confusing my apologies.

I already sent my marriage certificate to the USCIS, what i am asking is here in the US how to change our marital status. How can i fill for taxes when my wife application hasn't even been approved.

Right now my passport, my status still indicate single, I am just trying to gather info, if i need to change it to married, where would i go to in the US, and what proves the security state requires from me?

If you are legally married, you are married in the US's eyes. You can get a ITN number for your wife so you can file taxes jointly until she is here and will get her own SSN.

We're in the same situation, my husband will soon file his taxes for 2011 income, we got married in October 2011, so does he send the application for ITIN for me together with his tax return ? Adding a copy of my passport and a marriage certificate?

Or can it wait until I join him in the US?
