Hey folks, i'm having one of "those" days. You know the ones where up until now you think you have a handle on everything, then you look at all the paperwork again and nothing is making sense and you start to freak out!

Just wondering if there is a number i can call to find out some answers and i can talk to a real person, not an automated service. The USCIS Customer service number on my NOA1 is not helpful at all. We are coming up on 5 months since we received our NOA 1 and we have heard NOTHING. Not even a RFE. At the time of filing I-130, we were recommended to file I-129F in conjunction as a K3. We were told this would come through quicker than the I-130 and we could be together in the US and working while the I-130 was finishing processing. We have heard nothing on the K3 papers either (almost 5 months in). I know we are still within the processing guidelines, i just thought we would have heard something by now.

Please help!

The worst thing would be for them to process quicker and go the K3 route....that's what happened to me and although all of my process flew by (NOA2 in 42 days)....I"m paying on the back end. He was approved on 11.23 and they have decided to change it to a CR1 (not notifying us), thus delaying the issuance of his visa. When i filed, there were still a few K3 filers...and NVC is suppose to catch it and follow through with the I-130...but they didn't do their job with us and now we are waiting.

You took the right path...don't question that. I know this wait seems horrible...I have many friends also waiting just as long as you have....but its better to wait now for this, than to wait later after the approval, like I am ;(

K-3 is not faster than CR-1.

K-3 is more expensive and is closed at the NVC.

K-3 stops the I-130 in its tracks until it is matched up and put at the bottom of the pile with the I-129F.

If you read the comparison http://www.visajourney.com/content/compare

and the forums the general consensus here and advice is to stay away from the K-3 and stay with the CR-1.

Your timeline does not show that you have submitted I-129F to make this a K3. In anycase, if it makes you feel better, i know it wont. But i have filed for both I-130 & I-129F (K3) and I am also approaching 5 months soon.

Most people just submit I-130 for CR1 and many have not heard anything or received any NOA2. There are people waiting for NOA2 since their NOA1 in July.

http://www.visajourney.com/forums/topic/344393-csc-still-stating-june-16-date-for-i130/

K3 or CR1 i don't think USCIS is making any earlier processing time.

USCIS is moving EXTREMELY SLOW for many months now.

EXTREME Delayed process for both CR1 & K3 !

What the hell is going on? :bonk: :bonk: :bonk: :bonk: :bonk:

Just so i have it right, the I-130 cannot be processed until the K3 is??? I was under the impression that they ran at the same time and if the I-130 came through first, the K3 was cancelled out. Can i cancel my K3 application so i can continue on with the I-130?

The petitioner will need to call and see if they can cancel the K-3, You will likely have to fax/mail a signed letter stating you wish the K-3 canceled and to continue only with the I-130.

Your assessment is not correct, if an I-129F is filed in conjunction with an I-130 (to start the K3 path), USCIS ties the two petitions together by pulling the I-130 from its current place in the queue and placed with the I-129F that was just filed. The petitions are then adjudicated and a decision made on both at the same time.

Thanks everyone. Anyone know if it is possible to STOP the I-129F (K3) and continue with the I-130? As it seems it is going to take just as long anyway.

What will likely happen is this; if both of your petitions are approved, they will be sent to the NVC at the same time. If the NVC receives both the I-130 and I-129F at the same time, the I-129F for K3 will be administratively closed by the NVC leaving only the I-130 active.

IMO, the best thing to do at this point is to let things ride with USCIS and then allow the NVC to administratively close the K3. On the off chance the I-129F for K3 arrives at the NVC ahead of the I-130 and goes forward, you would still have a choice; if you want the CR-1, follow all processing steps at the NVC and ignore correspondence related to the K3.
