need help visa denied

Hi i need some information my fiancee went for her interview on oct 3 it was tuff they took her interview for good 2 hrs. they really pressurize her and when they wasn't able to find any reason to deny they told her that they think i won't marry her so the embassy won't give her k1 visa and ban her for life then ask her when i am going back to USA she told her oct 15 so that office told her to give statement that we will may before oct 14 and bring the marriage certificate and then they will give her visa . that time she get really confuse and upset and she make mistake she write what that office told her to write and he confuse her and dictate her and he dictate her that we already marry on oct 14 2010 and get her signature one the bottom she didn't realize that it is 2011 not 2010 and the problem is that that time my divorce was in progress in was done on jan24 2011 and they gave her refusal paper saying polygamy next day oct 4 2011 we got married. now i already apply for k3 visa but my question is on her next interview do they will give her hard time because of her written statement . my wife is really upset and worry about her next interview please let me know if any one can find the answer thanks

It sounds like the CO had a reason to believe you and her were already married. Did you have some sort of ceremony or were you married in Muslim tradition but not legally?

At this point you are going to need an immigration attorney to overcome the written statement she made.

Yes, the statement she made will come up in her K3 interview (actually, it'll probably be a CR-1 interview as the K3 is obsolete and usually closed at NVC stage).

It seems something triggered the CO being suspicious. You were married before and got engaged very soon after the divorce. Was your previous marriage to a US citizen and is that how you yourself became a US citizen?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

my husband got his green card via his father and he get his citizenship through his father there is nothing to do with his ex wife ( they both got their citizenship through their own parent). i get engaged while he was in devorce process.he file his divorce on june 2010and it finallize in dec 2010 and we engaged on nov 15 2010.before i engaged i search on internet it is legall to become engaged not to be married before the finalization of devorce process.we engaged on nov 15 2010 ther is no way getting marriage before marriage and in pakistan it is illegal in pakistan marriage without registration.my husband alredy hire attorney for k3 visa i am confused about my statment. i have all prove that we get marrird on oct 4 2011.(if we can wait 4 month why we can not wait for 2 more month it is only written error and confusion and misguidance. plz help me if you have any idea

I realise that, and you are also correct in saying it is not illegal to get engaged before the divorce is final. But it can be a red flag- ie a "bad point against you" that makes the CO suspicious.

its really hard to follow the dates you have provided :blush:

but you need to make sure she has all the documents that prove when the divorce was final....when you were married and have someone there do up a statement about her confusion when they had her sign the document at the first interview...if she has trouble with english islamabad does offer the applicant someone that can translate for her .........with the information you have provided thats all i can think of to help you but might be very beneficial for you to attend the next interview
