How to count my income on Tax Return filed married.

Hello All,

I started on my wife AOS today and I came across form i-864. Number 25 where it asks for my income for the 3 most recent tax year. I was married to my late wife and we always filed our tax married. How do I go about counting just my income for tax for question #25?

Your W2's will only have your income and not your late wife income. So you can use them.

Declare your income only in section 25. Whether you provide photocopies of the tax returns or IRS transcripts, provide photocopies of your W2's and/or 1099's to show what portion of the combined income on the tax return was yours.

Was last year's taxes filed as married or widowed? Did you use income from your late wife when you filed?

I re-read your question and saw that you mentioned the last three years. I misread, sorry. Remember, you do not need to show 3 yrs unless you feel it will strengthen your financial position. if you are earning over the poverty guideline, it is not necessary; however you should take them with you to the interview, because you need to have filed three years prior to filing. When I did the I-864, I had the same situation where one of the years was jointly filed with my late husband. I just took the total income straight off the tax return and didn't worry about separating out my portion, which was basically zero. It wanted to know a specific line from the tax return and that was my tax return for the year. I didn't have an alternate one. I also mailed in a tax transcript of the joint return with no explantion.

Nobody ever asked a thing about it.
