Hi! I'm a military wife and currently waiting for my ROC to be approved (filed in January 2012). My husband and I were looking at the N-400 eligibility requirements and one of them was:

  • Have lived within the state, or USCIS district with jurisdiction over the applicant's place of residence, for at least 3 months prior to the date of filing the application.

The earliest date I can file is January 2013 and we were planning on sending my packet then but we will be moving to a new duty station (different state) in April 2013. I know we will need to file at the Nebraska Service Center no matter where we live but because we're moving to a different state, should we wait until July 2013 to file my N-400 instead (to fulfill the 3 month state residency requirement)? Or is it okay to move while you have a N-400 pending? We're just worried that it would create a lot more problems since we'll be moving to a new USCIS district.

Honestly, I would avoid moving while your N-400 is pending. Unless you can be sure to get the whole process finished and done with before your move, I would just wait until after your move. However, I'm pretty sure they don't care about the 3 months residency stuff when it comes to military and their dependents.

Thank you for replying! ^__^ I think we'll wait until after we move to file. We'll make sure to call the Military Help Line about the state residency too - maybe we can file right after we move but if we have to wait for 3 months, it's not a big deal unless our I-751 still isn't approved by then. If that ends up being the case (hopefully not!!!), it would be great to be able to file the N-400 to force a decision on the I-751. January 2012 ROC filers have been getting approvals recently so we really hope ours gets approved soon too :)

People stateside will still have biometrics appointments even if they are military and file through Nebraska.

The instructions say that spouses of current military members regardless of living state side or abroad are to file through NE, and yes you still have biometrics appointments if you file through NE and are in the USA.

You wouldn't have biometrics if you have your appointment within 12 months of your last biometrics appointment.

Thank you both. Of course you are right. At the time that I had posted that I wasn't aware that all military and spouses file their N-400 through Nebraska. So needless to say I was a little confused.

I have been unable to find anyone else on this site that has been in England and gone through the citizenship process, so I guess I will be helpful to the next person. :)
