I applied for DCF in Slovenia on May 18, 2004. I did not need a cover letter. We made an appointment by phone and just brought the paperwork with us--it was very informal, friendly and an easy process. I am trying to remember what we even brought with us and I think it was: my birth certificate and US passport, the I-130 and G-325s for both of us, our marriage certificate, photos and maybe the i-864. Niko went to the Zagreb office for processing a few weeks later because Slovenia does not process immigrant visas and brought more things with him to that appointment.

June 2003: Meet in NYC

March 2004: Engaged!

May 17, 2004: Married! Domzale, Slovenia

May 18, 2004: Appointment at Embassy, Ljubljana, Slovenia (DCF)

I don't have them on this puter, and I have typed them out...so if there are any typos, they were NOT in the actual letter :D They were sent July, 2006

Why? Can you submit something before marriage in NZ?

Otherwise write everything as if you are already married, which you will be when you submit.

The cover letter is basically a checklist for YOUR benefit, so you don't leave anything out. Anything important that you have to communicate should go in an attachement.

RE: Petition for my wife to immigrate to the United States.

To Whom It May Concern:

I was instructed at the United States Embassy in Managua, Nicaragua to fill out form

I-864EZ Affidavit of Support. I was also instructed to show how I receive monthly compensation from the Veterans Administration (VA) for being a 100% service connected disabled Vietnam Era Veteran and how much money I receive.

For going on 10 years I have not generated any income and therefore was not required to file any Income Tax. I did contact the IRS about this and asked about filing a tax return so that I could attach it to this form. The person I spoke with said “please don’t clog up the system with a useless form for just an income statement” He went on to say. That if I needed it, he would provide me with a letter stating that I am not required to file a tax return.

I think the real question here is not wither I filed a tax return or not, but can I support my wife so that she does not become a public charge and drain tax dollars to support her. The answer to that question is, yes I can and will support my wife for the rest of my life.

Attached, I have documentation the provides proof that I have enough money coming that exceeds the required amount as stated in the poverty guidelines to support my wife, and I own a home for us to live in as well.

Support documentation.

(1.) On page (1 & 2.) of the support documents is a statement from the Veterans Administration (VA) stating that I am 100% service connected disabled and that I receive $xxxxx monthly or, $xxxxx annually. This document was authenticated by the US Embassy in Managua, Nicaragua and translated into Spanish; I have supplied both an English version and the Spanish Version. The amount exceeds the poverty guidelines for a household size of 2 people. Also, disability compensation is not taxable income; therefore I have not been required to file a tax return for years. Also, please note;

U.S. Department of State Foreign Affairs Manual Volume 9 - Visas

9 FAM 40.41 Notes Page 24 of 35

(4) Evidence of Sponsorship Eligibility–Evidence to establish eligibility

as a sponsor, including citizenship or lawful permanent resident

(LPR) status, age and domicile (as defined in 9 FAM 40.41 N5.2).

b. Tax-free income (such as a housing allowance for clergy or military

personnel) and other tangible benefits in lieu of salary are considered

income. The sponsor bears the burden of proving the nature and amount

of income.

c. Assembling the documents is the sponsor's responsibility. If Form I-864,

Affidavit of Support Under Section 213A of the Act, and supporting

documents are incomplete or poorly assembled, the post must refuse the

applicant under INA 221(g) and return the entire package to the applicant

with a copy of the checklist. However, you should no longer refuse

applicants under INA 221(g) just for failing to provide the three most

recent federal tax returns.

I’m not trying to come across as a “know it all” God knows I’m not, I’m just trying to get my wife home with me and I found this information while I was searching for a way to do that.

(2.) Page (3.) has 5 items marked, A, B, C, D. and E

Item A. is a check from the Bank of Albuquerque with my name and current address

Item B. Department of Defense ID card proving I am a Disabled Veteran

Item C. New Mexico Hunting and Fishing license with my current address

Item D. New Mexico current Drivers License with current address

Item E. Current membership with the American Legion in Albuquerque, NM

(3.) Page 4 is a Bank Statement from the Bank of Albuquerque; I still use this bank almost everyday in the form of an ATM card. It also has my current address on it

(4.) Page 5 is a letter from the company (REGIONS MORTGAGE) that holds the mortgage on my house. The loan number and the amount I still owe is there, one phone call to this company will confirm that the mortgage is in my name and that my payments are current and that the address is the same address in all my support documentation.

I hope I have been successful in demonstrating that I have fulfilled the finical requirements and the domicile requirements needed for my wife to be granted a visa.

If you have any questions or there are any problems, please contact me at one of the phone numbers that head this letter before you refuse my claim, perhaps we can clear it up and have it resolved before hand. I can not begin to tell you how important this visa is to me.

Yours truly,

Ervin W. Armstrong
