TO CAsablanca and all the denials

How can one give more proof of relationship and have a better interview with the Spousal Visa when the first time around was not found Bona Fide yet...an actual reason for denial was avoided.

I did the emotional emails right after, I called, I emailed and emailed...to no avail. I had received the first reply to my email indicating Madame, it was not denied just "sent back for further review" and to contact USCIS. Then they replied to another email that it was sent back on a certain date and and they cannot help me...By the time it was back in the U.S. I eventually received a letter indicating it was denied and they will not further continue with my case. No reason given...So with all the info on VJ I can assume we were just naive going into the visa interview that it would be handled with impartial professionalism....

So now that I had the opportunity to visit Morocco for the 3rd time...to marry my love..and have filed for the spousal Visa...does anyone wish to share their experience at Casa after the K1 being denied and the interview for the Spousal Visa???

It would help me to know if they still want photos and same type of evidence, if anything more is requested? Thank you to everyone on here. I come here often not to feel completely helpless...if that makes sense to anyone :)

You are submitting an entirely new set of documents. Many items will be duplicates of what you submitted as part of the K visa petition.

Was it lack of evidence, or a poor interview for the K visa? Your K visa file is going to be a factor. So be sure that you address the weakness of the K petition when submitting proof of a bona fide relationship to Casa.

the best thing is go for morocco and get married and start CR1 that is my advice for u bcz if u wait uscis may be that will take long time GOOD LUCK

Thank you for the advice!!! I am married Thank GOD and did submit the Spousal Visa :thumbs:I was hoping to get someones experience on the next interview.

Respectfully in hindsight, it was a hard interview on the fiance and we did not see it coming...just thought that our love and his honesty was good enough...And I fit the worst case scenario, I am older, divorced, etc....

I will make sure we have tons of our photos, airline tickets, daily emails and ims, marriage photos etc...Just wanted to get a heads up if there is additional things to what now I (painfully) know I need...

Hello, I just wanted to throw in some advice as well. It's very true that the Interview process is hard in Morocco. Since you said you were older and divorced this is where I hope to shed some light for you the next time around for your husband.

My story and red flags were:

1. 15 years older than him

2. divorced with 1 child

3. never worked the last 13 years as i was a stay home mom

Now if I was a CO, I would have denied my fiance just on those red flags alone..... However, during the last two years, I spent a lot of time in Morocco 6 trips to be exact and spending three weeks on each visit. I had every transaction from car rental, money exchange, villa/apt rentals, etc. I had all the chats/phone cards/ etc. as well. His interview went very smoothly and only one question stunned my fiance and the CO said are you sure you want to keep that answer or shall i call your fiance and talk with her. The CO called me at work and asked about our relationship and confirmed every thing that my fiance said. The Co said okay all looks good and I will approve the visa. Now happily married one year later all is good and life is wonderful for the two of us.

I do believe knowing the US fiance is such a big part of the interview and answering truthfully. The CO's can and will go back in time and look for anything on his chats with other women and use this against him if they feel it necessary. They knew way too much about my fiance and his chat logs we never disclosed to them from 5 years ago. So go figure....

Go back to Morocco and spend some time if you can, this is my best advice and the CO complimented me on all my visits to Casablanca.

Hi, I took down your email but I would like for others to know this as well just in case they are going through what I did with the income situation.

I did not need a co-sponsor at all. I was approved on my assets and child support and part time job that I had just gotten. I got a part time job just about 3 weeks prior to his interview in Morocco. I could only show one pay stub, but I had funds in the bank and so forth. I had two cars paid off and a camper and I sent copies of the titles and all information and proof of assets just in case. I also received through my divorce a 401K settlement which I believed is what gave the CO the go ahead to approve him his visa. During my interview, the CO said well all looks good but you will need a co-sponsor. I said why? I stated to him that according to the directions on the I-864 any assets can be added along with income and my child support. He said well hmmm I have not seen any of this let me go up front and get his file. He came back within a few minutes after reading the I-864 and said yes you do not need a co-sponsor and everything looks fine.

So basically, that was it.... I was as surprised as anybody here reading this when it comes to the Moroccan Embassy. Call it lucky, call it faith, I am just so grateful we made it through. If you need add'l help just let me know.

im same as u my wife from US she is older than me ihad interw twis on 2009 and they give me g221 and they send our case back to US after almost 7months of case back to uscis we got paper give why they refuse our visa and they asked us to send more proofs and we when they got proof they are going to answer us after 45days but that didnt happen it was take long that after almost year and few months of had interw we got denied then we did start new case CR1 idont want that happen to u to wait all this time then in end nothing there is other choice u do u need to call nvs and ask them if u can start new case with ur old I130 then u can have new case and ur case will back to casablanca soon with new number case if not then u need to call uscis and ask if u can cancel the old case and start new one and u need to ask about that more here in vj and uscis and lawyer so u will not have any problem in future isaid that cus if u wait ur case back to uscis fro casablanca im worry of u havee same as us wee have been wait for more that 1year and nothing and ill give my wife ur email and she can explain for u more good luck.

Your letter actually said you were denied????? This happen to us as well but the letter I receiced once our case was back in the states said our case had been closed because the dates had expired and that we could file again..... From what I have seen here if you were trully denied it would be good to find out why your were denied because just getting married does not always fix the issue.

Was curious as to your response. How would you know what to address if I have heard that some couple's process (K-1) was simply denied (send via e-mail). THey never received a decent letter stating reasons. I have constantly called USCIS due to same situation. Under AP for K-1 with no response with exception that I need to wait, wait!!! Wait for it to expire more than likely...

1. During your interview? Can the spouse be there? I was going to be in Morocco for his interview but assumed I would have to wait outside across the street at the CAFE. You were blessed.

2. I did send the sole owner ship of real estate, paid out car, funds in bank and assets etc...but not the return taxes being my EX always filed me as a dependent up until the last year of our divorce. So I assumed with my mother as a co sponsor, if i am not sufficient according to the 1040, then she would qualify.

No the letter was the Notice Of Decision indicating the beneficiary was not issued the requested K-1 Visa and there fore blah blah blah

in accordance with 8CFR 214.2 (k) blah blah blah action on this petition is concluded...etc. I felt denied :angry:

So when they said to wait and contact USCIS... I assume this is a denial???

Anyways to answer your question...no the letter never said I was denied. I got this letter that you received too...so We are not anymore special than you ..... :unsure:

Just wish not to make any mistakes in the next interview...GOD Willing we get one.

Yes, fiance had interview to be exact July 13th but to this date haven't received a single thing, no email, letters nothing. I do call every week (USCIS) and same thing, simply to wait and wait. Supposedly 1/22/12 will be the date of expiration but I have hard it could be extended but do not know who and how to extend it. I was curious because one of my friends had her interview (fiance) 2 weeks after and SHE DID get letter stating it was expired, so why did hers (theirs) expire and mine didn't. Again, they were interviewed 2 weeks after, I don't understand this. As far as correcting this Notice of Intent to Deny (NOID), how is it possible to correct it when they simply either tell you it's expired or denied, no other explanation...I am really concerned because if nothing else I am planning on going to Morocco and doing the exact same thing you did, marrying him but again, the issue is to CORRECT reasons but what reasons if they do not either tell you or mail explanations...
