Thanks for all the helpful hints. My wife and I do have a lawyer that filed our appeal. I was hoping to find some one who went thru the appeal process. I will call the USCIS again tomorrow to try to get an update

I've a serious question...

In such a situation... presuming it isn't in error...

Is there any reason not to just begin plans to move to China? Has anyone ever beaten this kind of thing in a period not measured in years?

When I read the OP post, I wonderd the same thing. If the petition by chance does get denied again after the appeal/waiver then is it possible to move to China and make a life as best as you can with your wife there?

When I read the OP post, I wonderd the same thing. If the petition by chance does get denied again after the appeal/waiver then is it possible to move to China and make a life as best as you can with your wife there?

From what I understand, and could likely be wrong about, it is the appeal/waiver part that takes forever. Were I the OP and if the ruling wasn't an outright mistake, I'd be laying plans to move right now.

It's been my plan for a while that if our interview doesn't go well, the next step is to fight, the very next is to move to China.

My wife's visa petition was denied. We are in the appeal process, does anybody have any information on the appeal process its been 9 month since we filed with no information from the USCIS

if I remember your case, a couple of months ago you were accused of child molestation and you find out guilty, but you went to got therapy and you are now ( cure) and you been trying to change your life. Sorry, I would not trust you either. Sorry to say this I hope she does not have kids.

I won't highlight any comments from members here because anytime the Adam Walsh Act is the reason for denial it is DEAD SERIOUS. You are legally married and asking for help. Well, a Conviction could vary to how extreme the Crime commited was but The Adam Walsh Act specifically says It was and is a Felony.

I'm not saying your deserve a second chance but maybe you do and have changed? I'm not a Judge.

So my question(s) to you is: Did you tell the truth on the Petition?

Did you Consult with an Attorney about a Wavier showing the time-span of the Offense/Conviction and show treatment for this Conviction. You can file this on your own but is highly un-recommended. (Wavier) Get an Attorney.

You will have to Prove you are rehabilitated, no danger to your spouse and ANY children and/or others.

I would get a Attorney if you fell you can show this and documentation.

If you can't do this, then divorce and let her go on.
