if the marriage was entered into in good faith and he still has his 2 yr green card (non-expired) and his idiocy did not involve criminality or immigration fraud, he can continue his immigration without you if he returns to the US.

if you want to divorce, go ahead and move on with your life.

It doesn't do anything to his green card. He has it, hes able to file by himself to remove conditions on it after the divorce and get a 10 year card. He can travel as he wants to, or he can choose to just stay in Panama and not come back and not do anything about the green card. Its his to do with what he wishes.

File divorce and move on, you cant really do anything about his green card.

I believe I read that even in case of divorce, the financial responsibility for the beneficiary remains that of the petitioner (and not a burden of the U.S. government's social programs)unless they remarry or some time (10 years or so) has passed...So you may want to find out more precisely what financial ramifications would still exist. Just a thought.

Sort of. The petitioner does not have to support or give money to the beneficiary. But if the beneficiary uses means-tested benefits, the US government can come after them for repayment. In many cases an immigrant is not eligible for benefits anyway, though.

New LPR's aren't eligible for the majority of means-tested public benefits for the first five years. The "10 years" you're thinking of is if the immigrant is working and paying Social Security taxes. The enforceability of the affidavit of support is terminated if the immigrant accrues 40 quarters of work credit through Social Security, which happens to be 10 years. If they sit on their butt and don't work or don't pay Social Security taxes then they may never accrue the 40 quarters they need to terminate the affidavit of support. It's possible for the affidavit of support to remain in effect until either the sponsor or immigrant dies.

Anyway, the terms are spelled out in detail in the I-864 contract.
