i-134 and Employment- Confused please help!

Hello Everyone!

I am new to VJ as you can see, I haven't even started a timeline yet! I am getting read to send my Petition in for a FIANCE VISA. However, I am also getting together all the other documents my fiance will need for his interview because I will be going to Ghana to be with him for the next 4 months. Therefore, we want to make sure we have everything ready while I'm there, just in case he gets an early interview date. So here is my question:

I am going on unpaid leave from my Employment starting in January 15, 2012 until around May 15th, 2012. Therefore, will I still put my current annual income as it was for 2011, even though it will be different in 2012? Also, will i need to include this in the letter from my employer?

If anyone has advice or could point me to a place where I could find out I would REALLY appreciate it. Thank you SO much, I really appreciate this website and I have been searching through old posts for this answer!!

You won't be receiving your NOA2 until 2012, which is when he'll have his interview.

At that estimated time, it's assumed by the consulate that you (the USC) has filed your taxes. They ask for your most recent taxes which are filed (which would be your 2011 taxes). However, you also need to provide an employment verification letter.

If your income is 125% of the poverty line, you'll be fine.

I'm not entirely sure, but it may become somewhat of an issue during your AOS process *if* your income is not 125% of the poverty line for the remainder of 2012.

Hopefully more VJers can shed some more light.

But, we've had no issues. It's coming along. Interview should

be shortly coming. Married life is great*

Do not confuse "employment" with "working" If you have been granted unpaid leave and have a return to work date AND a return to work position and salary, you ARE employed. You are just not "working" for a few months.

The I-134 makes the statement "I am currently employed and derive an annual income of____________" YES, you ARE employed. What is your ANNUAL salary? Hint: If your annual income is $45,000 and you take 4 months off work unpaid, what is your annual salary? $45,000.00 Your annual salary does not change, (unless it does change due to you absence, I cannot answer that)

The I-134 DOES NOT ask "how much have you made so far this year?" and it DOES NOT ask "how much did you make last year?"

The best way for you to handle this is to fill out the I-134 when the time comes with the pertinent inforamtion and attach an employment letter verifying you position and income. No mention need be made of your time off, they do not ask and they do not care.

Oh that makes so much more sense!!! SALARY is not INCOME. It's your rate of pay, that you typically get every 2 weeks, right? So my salary will remain the same, I just am not receiving it until I get back and the form doesn't ask about that. THANK YOU!!!

They indeed trying to anticipate your potential to sustain you and your partner when they get here, not trying to know how much u will have stashed by then
