Yup a spouse is not a dependent, not sure why so many people think this.

You file taxes married joint or married separately.

Work permit has nothing to do with filing taxes married joint. He needs an SSN or ITIN though to file the taxes with you.

even if he is not working? he doesnt have his work permit yet !! I mean how do I put it when I file my taxes on 2012?

I have filed taxes jointly with my husband for 2 years and not worked a single day in the US since moving here and getting my green card.

You file married joint and use his SSN number and 0 income.

Like i said, not working has nothing to do with it.

I'll borrow this thread for another tax question.

My wife (USC) and I are moving to the U.S. in February (I'm immigrating using a CR1). I'm assume that I do not need to file any taxes in April (for 2011) since I will not have been a Legal Permanent Resident until February of 2012?

That is correct - you do not need to file taxes. Your wife, however, should file taxes as married. There are instructions in the 1040 tax form on how to calculate a non-resident spouse, or she can simply file "married filing separately." As a USC she needs to file taxes even while living abroad - though she will likely not have to pay anything, she must report income.
