K1 visa soon to be 18

We started our k1 visa process when I was 17. Just submit a minor's marriage consent form (from the state where you're going to marry)along with other i-129f requirements. We got the NOA2 (approval notice) 4 months after we got the NOA1 (Receipt Notice). My embassy interview was 24 days after I turned 18, and we were approved! And we just filed our AOS. I met another VJ member who also has the same experience and she just received her conditional greencard. No worries! You won't even need a lawyer. Good luck!

By the way, did the CFO ask you to submit the Filipino "Consent to Marry of a Person Under Age" document?

Tim, Dan is correct. We filed our K1 when I was 17, got the approval notice 4 months after the receipt notice and is approved at USEM interview. I met another VJ member with the same experience. She even had prior k1 petition (filed by her ex-fiance),which was approved after a few months but she cancelled later on. Her 2nd fiance (now husband) filed her i-129f and got approved in 5 months! Her AOS was approved too and she has her conditional green card now.

Pretty good multi-posting for a nOOb. I would say you have done this before.

just curious how's that done for a person who is a citizen of and residing in another country?

Doesn't matter where you are a citizen or where you reside in regards to getting married in a certain state all that is necessary is that you meet their requirements for getting a marriage license.

the USCIS does not regulate marriages, but they do set requirements for filing a petition. when filing the petition you both must be free to marry.

in the Philippines the age of consent is 18.

I agree with this statement regardless of what the 129F states. Bottom line is you can't marry in the Phils until age 18 and I wouldn't bother taking the chance to possibly being tagged in a negative way.. DOes it happen, absolutely. Anything can be done for a price. Just wait it out the few months util she is 18 and then there is no questions. If you can't wait, get a lawyer who is a professional in these cases...

And I support your decision to find a young girl. Do what you think is right and makes the both of you happy!!!!

05 DEC 2012: NOA's I-765, I-131, I-485

14 DEC 2012: Biometrics appointment finished(Walk-in..Was scheduled Jan 04 2013)

02 FEB 2013: I-131 and I-765 Approved

07 FEB 2013: USPS Picked up the combo-card

11 FEB 2013: Received Combo-card

21 FEB 2013: Transit Visa picked up in Chicago for Japan

BTW, make sure she always has a chaperon with her. One of the typical scams is for the local constabulary to break through the door, and you suddenly "discover" you are alone with an underage girl. After you hand over all your cash and belongings, they might give you a ride to the airport, if you are lucky.

You should read the post a little more closely we dont plan to marry in the phils.That link gives information towards anyone that wants to get married in the phils. We are planning to get married when she is 18, we just want to start the proccess

Just my opinion but whats the rush? Just wait the few months and file it on her bday.. then there will be absolutely no issue. 7 months is a good assumption but thats not set in stone, it could be less.. a lot of people got i129f approvals in 1-3 months too (though unusual). I know you will say you dont want to wait, and thats understandable.. all im saying is that if you are really worried about this then just wait it out.. either way, goodluck! :)

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Good luck to you and congratulations hoy123. Just ignore envy and spite.

Using the search function, this has come up before and it does look like the solution is the consent to marry from the parents.
