Not necessarily, as they still have to get permission from the Philippines to leave the country. If she is a minor, that would be difficult.

yes this is true she has to get a stamp on her passport before she leaves the country..... but she is turning 18 in july so i dont think we would have a problem there kasi the whole process will take around 7 months

The Affidavit of Parental Consent has to be prepared by a lawyer licensed to practice law in the Philippines, and the signatures of both parents duly notarized thereon.

Nothing at all is needed to Notorized on a 129-F Petition. Parent Consent if applicable is given at the Interveiw.

Parental consent/advice for Filipinos is not applicable at the Embassy interview. It comes into play at the CFO seminar. Sheesh... :wacko:

hmm one more question popped up should i get an affadavit of parental consent drawn up by a lawyer or should i just get a parental consent form notarized by a civil registrar to send with my initial K1 application?

It seems as if the affadavit created by the lawyer is more geared towards getting married in the phillipines.... maybe it doesnt matter either one will be fine

You shouldn't be able to get either one until she is 18. Civil registrar generally handles marriages, and such a form would be executed in the process of getting a marriage license with all parties present. A lawyer would be needed to generate such a document that can be shown to anybody that might require such a document, would require only the lawyer acting as notary, and the parents present to sign the affidavit.

yes she does if shes 18 and we plan to get married in the phillipines... but we're planning on getting married when she is 18 and living in the US.. the consent form would just be to move the process along until she turns 18

Hello my fiance is going to turn eighteen in about 7 months and i was wondering if i could start the visa process now and have her get an appointmnet for the interview after she turns 18. Im trying to go through the proccess myself but it seems as if i might be better off getting a lawyer... unless anyone here has any advice on the issue.

Her parents are fine with it and are willing to sign any consent forms in order for the marriage to take place as it is perfectly legal to do that in the United States.

Im just wondering if i should hand in a consent form with the I29 or maybe a letter stating that the benificiary will be 18 at the time of interview.

does anyone have any experience or can refer me to someone that can advise me better

We started our k1 visa process when I was 17. Just submit a minor's marriage consent form (from the state where you're going to marry)along with other i-129f requirements. We got the NOA2 (approval notice) 4 months after we got the NOA1 (Receipt Notice). My embassy interview was 24 days after I turned 18, and we were approved! And we just filed our AOS. I met another VJ member who also has the same experience and she just received her conditional greencard. No worries! You won't even need a lawyer. Good luck!

I don't think the USCIS is concerned with her actual age, only if there is like a 30 year difference between you. And there shouldn't be a problem if her parents are willing to sign a consent form. unless it actually states in the petition instructions that she needs to be 18, there shouldn't be a problem. I was 19 when I completed all mine.

This is #######.. You cannot even File until she is of Legal Age. Some Countries require Consent of the Parent (s) even after 18. You are not dealing with Wal-Mart here. You are dealing with USCIS

you can apply now and you should include the letter of consent from her parents. marrying under the age of 18 will depend on the state you plan on marrying in though

Tim, Dan is correct. We filed our K1 when I was 17, got the approval notice 4 months after the receipt notice and is approved at USEM interview. I met another VJ member with the same experience. She even had prior k1 petition (filed by her ex-fiance),which was approved after a few months but she cancelled later on. Her 2nd fiance (now husband) filed her i-129f and got approved in 5 months! Her AOS was approved too and she has her conditional green card now.

It has been a Confusing Subject. I read this link over a year ago and remembered/found it.

So I could be very wrong with my previous posts about Petitioning a 17 year Old. This Link pertains to Marrying in the Philippines. I think the OP seen this link but does actually not pertain to his situation since it will be a K-1 and takes time. (he is not asking to marry in the philippines at this time)

I'm still highly confused due to the fact that the 129-F Petition will ask for Birth Certs, G-325-A, that all will show the Age of the beneficiary. A few posts indicated: By the time the process is over she will be 18. This maybe true and thats where I might be wrong.

It does seem clear on the link that the Parents permission is needed.

JUST UNTIL SHES 18 and make it much easier on yourself.
