Where is YOUR COMMON SENSE.? Show me a Link that Supports the OP's Filing before Adult Age and YOU DON'T EVEN KNOW THE COUNTRY or Jack

You are the one who is making claims. You won't back up your claims by providing any kind of link. Now you're admitting that you are flying by the seat of your pants.

@OP...I've learned to ignore Tim's "common sense."

Hello my fiance is going to turn eighteen in about 7 months and i was wondering if i could start the visa process now and have her get an appointmnet for the interview after she turns 18. Im trying to go through the proccess myself but it seems as if i might be better off getting a lawyer... unless anyone here has any advice on the issue.

Her parents are fine with it and are willing to sign any consent forms in order for the marriage to take place as it is perfectly legal to do that in the United States.

Im just wondering if i should hand in a consent form with the I29 or maybe a letter stating that the benificiary will be 18 at the time of interview.

does anyone have any experience or can refer me to someone that can advise me better

thanks,

You must BOTH be legally able to marry at the time you file the petition. That means if parental consent is needed it must be obtained and submitted with the petition.

The I-129f instructions cover this matter specifically.

Both the U.S. citizen and the K-1 visa applicant must have been legally free to marry at the time the petition was filed and must have remained so thereafter. The marriage must be legally possible according to laws of the U.S. state in which the marriage will take place.

Just as I thought...no link...

Instructions I-129f 5C. They are available at this site or at http://www.uscis.gov/files/form/i-129finstr.pdf

You do not need a lawyer. You need to provide proof at the time of filing that you meet the requirements to get married in the state you intend to be married and if any prior consent is needed it must be obtained before filing.

Enjoy

Philippines has its own marriage requirements, and those have to be satisfied at the time of filings:

Marriage applicants who are age 18 to 21 must have parental consent in writing, those age 21 to 25 must have written parental advice (a written indication that the parents are aware of the couple's intent to marry). The revised Family Code of the Philippines, which took effect on August 4, 1988, prohibits marriage for individuals below the age of 18.

NO

Yes they can. The instructions specifically state that if parental consent or any other special consent is required it must be sent with the petition

There is NO specific reference to age in the instructions.

This is true and they must also be met because Philippine law specifically covers all PI citizens regardless of where they marry. Strange but true and the US respects this. In fact I think PI women even need parental consent of some sort up to age 21.

No problem if you have it when you submit the petition.
