The requirement for the petition is that both the petitioner & beneficiary must be free to marry WHEN THE PETITION IS FILED. You need to wait until she's of legal age.

I would suggest your post requires an immigration lawyer to assist you. Advice here cannnot be taken on this topic. This is a case where the laws in your state plus the USCIS and the country of immigration laws all differ to some extent. any advice given here is not able to help you in any legal issues you run into during your process.

Wish you the best of luck. Sit down with an immigration lawyer. Make sure it is one who has been in business for years, and dealt with these issues.

I think your full of Pucky! You don't even have a Timeline for the OP or Country. So you are guessing and will not admit your fault.

That Petition requires Legal age. In the the US, a USC and USC without USCIS involed is different and ages vary State to State. This is not the Case. It is a Immigration Isuue and Each Country has there separate Laws.

YOU CANNOT FILE UNTIL SHE IS OF LEGAL AGE. PARENT CONSENT OR NOT

File your 129-F and spend the Money. Do all that work for nothing. And you will be REJECTED. JUST Wait until she is of Legal Age.

USCIS does not regulate marriges neither does the federal government only the states regulate marriage....

where is the USCIS constitution? i would like to see the amendments concerning marriage
