Okay someone please calm me down and verify what someone told me about AOS.

If I didn't work last year I do not qualify as a sponsor?

I have 2008, 2009 and 2010 returns.

I have no one to even ask to be a co-sponsor so can someone please tell me if this is true.

Oh my present job that I just got hired for will start in mid-january and it pays more than enough. I thought it was more about can ypu support them now, not what you made in the past.

You, or a joint sponsor, needs to show current and continuing income the meets the requirement. This is will need to be supplied at the time of the interview, not the petition filing.

Supplied during the NVC phase of the process, not as late as at the time of the interview. It is a common misconception that because they ask for three years of income from tax returns, they require you to qualify each and every one of those past years. Although past income is asked for, current income is the key.

2011 income 0, unemployment $3200

2012 income with new job $94000

This year I lived with husband in Nigeria from March to September.

Man a co-sponsor is just not feasible. gosh to ask anyone this is too much ya know.

Take it easy, you should be fine if you provide proof of that as your current income (especially if your interview is several months from now - which gives you time to prepare paystubs, employment letter, etc). I wouldn't say a lawyer is a bad way to go - but it shouldn't be something you seek out because of worries about income from last year. If you meet (or in your case, exceed) the requirement as listed for CURRENT income, you're good. If you don't, a lawyer won't change that.

since you are doing the IR/CR1, you will need the I-864 at the NVC stage and your current income is the key as a previous post rightly said. Just get you employer( HR department) to issue you a letter of employment, stating your post in the company, period of employment and ANNUAL SALARY, is it temp or permanent positon shd be included also.

Then you shd add IRS transcript from those years you mentioned to support your case.

What stage are you in the process as that info will better help advise.

Calm down ( easier said than done). Just stay strong and it will work out well. if you have been approved etc, I wonder what more a lawyer can do for you except pocket your money (IMO) unless the case is a "complicated" one.

Thank you all. I do feel better indeed. Yes the position is a permanent one. Thank God after all these contracting jobs.

I have not started my visa journey. Was just getting everything in order and I will finally send everything January 3rd.

I know I need to calm down but you think you thought of everything and than you read another thread that sounds like it relates to you.

But thank you all. I am excited to finally be able to enter a time line. Here's praying the speedy USCIS processing continues in 2012.
