Barath, in my interpretation of what was wrote,I think you must be a citizen for 5 years before you are allowed to trasmit. It seemed to me that you also had to reside in the USA for the previous 5 years and not live aboard. It would be a good idea to research that question unless someone else knows more about it though.

Ok, I got this statement from Embassy of the United States from my country:

Thank you for your e-mail. You should have five years of physical presence in U.S. before the birth of your child, It does not matter on which status you were residing in the U.S.

For the new born child you will have to file Consular Report of Birth Abroad and U.S passport with the relevant Embassy/Consulate (if you have qualify according to the law).

American Citizen Services

It means that you have to show 5 years physical presence in U.S.

They made us file (together) in person (Dhahran)

I was also born/raised in the US and had to show (5) years of physical presence. I gave them my old passport, current passport, and (4) years of school records which was all I had. The joke was that my first passport was issued in 1974 and I did not even have a passport until 2006 (which is the cancellation stamp date on my 1974 passport LOL) so I didnt have any way to actually be out of the country for (22) years.

Dude correctly guessed that my 2006 passport was issued so that I could go visit my wife / subsequently get married and that was pretty bright / perceptive for a guvment flukie.

The passport took about 2 weeks to be issued BUT once the application is filed and accepted your presence is no longer required - it is mailed (FEDEX'd in our case) to the foreign address given (some embassies ask that it be picked up and either parent can pick it up).

We did not file for SS card at the embassy as they advised us that filing abroad for SS number takes weeks to months to process (through Athens as I recall). We waited until our next US entry (born in May, entered US the following Dec) to file for the SS card.

If you get a visa for a US citizen that potentially snarls up your baby's records for all time as US citizens do not qualify for visas.

You MIGHT ask if they will accept the parental waiver form. If so you can fill it, notorize it, and fedex it to your wife and she can possibly do the application. They might ask for proof of parenthood or might not - see comment on DNA testing, etc. The right unit at the embassy to ask is ACS (citizen services)

http://travel.state.gov/passport/forms/ds3053/ds3053_846.html is the link to the parental consent form for passport applications. The trouble is - you are filing for report of birth abroad and that, in our case, required both of us to attend.

Something else I am wondering is, the things they require to show legitimacy and the passport request, do I have to deliver documentation myself or can my wife deliver these things to the consulate? If I traveled over there, I have no idea how long it would take to process all these things and get my hands on the passport and all the required things. I have a business here and cant get away so easy. Does anyone have some input on that topic? Surely they consider issues like that?

so it means that you have to spend 5 years(at least) as a U.S. citizen to qualify to transmit U.S. citizenship to a child? even though you living 10 years in

USA legally?

Not correct.
