Hoping someone else has encountered this request...

My husband's conditional green card expired on 4/1/2011. We mailed our paperwork THAT DAY. So it was postmarked 4/1/2011. We have the receipt and copy of the post mark in our file with everything else. I'm sure you all know that getting a straightforward answer from anyone at USCIS is impossible, but some online research reassured me that they would honor the post mark date. We got a notice that our paperwork was received a few weeks later, then a notice for his biometrics appointment, which was in mid July. We heard NOTHING until last week. It was a request for more information. However, what they are requesting is an explanation as to why we filed late.

For 6-9 months before filing, we were really struggling financially and we had to wait until we KNEW that the check we mailed in would not be returned for insufficient funds. If we explain that, will that be good enough for USCIS? Why do I read that others that filed on THE LAST day didn't have any problems?

I think I would be very apologetic and explain why I filed late and hope they were ok with that.

They are explicit that you need to file in the 90 days before the date on the conditional card.

They have sent your husband for his biometrics so I imagine it's alright. He just needs to explain his reasons for filing late.

cutting it so fine is a bad idea. that comment is directed to lurkers who are trying to find information about how close to the expiry if the conditional green card they can file.

the ROC package must not only be postmarked before the exipiry date, it must arrive AND be processed by CSC or VSC. therefore, latest you should send it is about a week in advance. to be safe, if you are filing late in the 90 day window, it is recommended that you include a letter of explanation detailing honestly WHY you are submitting so late.

based on VJ accounts of late filing, those who include this letter experience fewer delays that those who simply send off a late package.

im very surprised your package was accepted. most people report their packages sent late like yours as being returned by USCIS.

send the letter and youll probably be in good shape.

That is USCIS discretion, if they decide that is ok then they will accept it. If they decide that its not ok then they can deny it. Send the explanation back fast.
