Timeline

So we got an RFE letter in, on xmas eve none the less! Didn't even know it was there till xmas morning. Nice first xmas with my wife, THANKS USCIS!

The letter is simple yet confusing. We followed the instructions for the affidavit (page 8) to the letter and I have a copy of everything we sent. The only thing they're asking us to resubmit is the tax returns (W2's and 1099's) on form I-864 for my wife WHICH WE DID the first time around. And, the income tax returns for I-864A for my mother in law which we DID the first time round I have the copies sitting in front of me. The only thing I can think that would be the problem is that they were electronic, we printed them off, but my wife files online so hers ARE electronic. We plan to phone them in the morning and double check but can anyone shed some light on this??

I really want my EAD through so I can start pulling my weight money wise, my wife doesn't care but I do, I want to share the load and this has put hold on processing.

Also is my biometrics still a go?? it's coming up soon!

Hi! We have also submitted tax returns of my husband (sponsor) for the past several years. One of them was filed electronically as well. USCIS did not say anything regarding this so far (and hope they won’t)

We had an RFE but it had to do with a medical form. Not sure what is the criteria for asking actual transcripts… I see that you already made a request from IRS today.

I also noticed that we both sent out our AOS packages on the same date November 18th! My biometric appointment is also next week, on January 3rd!! Hope you’ll hear some good news from USCIS soon! Good luck to both of us!!:)

Hey all... I just want to make sure I have this clear. If you have the tax transcripts you are not required to submit the W-2's or the 1099 copies? You would just submit the pages provided from the IRS and the I-864?

Unfortunately, I dont have my own transcripts and can not order them until next week (the IRS can not access information as they are doing yearly upgrades) which would put me out of time frame. So for myself I will probably have to send my tax returns (which were also submitted online). Sheesh!

Yes IRS transcripts are all (no w2 etc to attach).

What is "out of time frame"? You received an RFE or are you talking your I-94 will expire. There is no deadline to file AOS.

For you and anybody else submitting tax returns instead of transcripts---

If you use TurboTax or go to H&R Block you can end up with a mountain of pages that aren't the actual return. USCIS is looking for tax return pages that look like below:

Every body starts with ONE of these-

1040 http://www.irs.gov/pub/irs-pdf/f1040.pdf

1040A http://www.irs.gov/pub/irs-pdf/f1040a.pdf

1040EZ http://www.irs.gov/pub/irs-pdf/f1040ez.pdf

Then depending on how you earn money and how much, you might have one or more of these, or even different ones--

It may have been generated by TurboTax or H&R Block for informational purposes only. If you don't have transcripts, then make sure you send Forms and Schedules that look like the above examples.

Transcripts will cover everything I need though right? I read a comment on here that if you get RFE'd for the same thing twice you're flat out denied, I have no idea how much paperwork is coming with the transcripts or if there will be a problem with it when it arrives! It's scary to imagine that I could send away the wrong thing twice!

Four ways to order. I've used all four and with good results

  1. If you have a fax machine they will fax the transcripts same day. Call them and speak to a person. 1-800-829-1040
  2. Online ordering is here http://www.irs.gov/i...=232168,00.html
  3. Automated phone ordering 800-908-9946. Follow prompts.
  4. Mail or fax in request paper form http://www.irs.gov/p...-pdf/f4506t.pdf

#2 and #3 you receive by mail at the last address they have on you. If anybody has moved since filing the 2010 return, then those won't work.

Transcripts will cover everything I need though right? That post with examples of what a tax return should look like was for people who efiled or did online so they could look at what they had, and know what they should be sending---things called Form xxx and Schedule xxx. Also any W2s or 1099s received have to go with that. It was for people that don't get transcripts.

If you get a transcript, then it stands alone without the w2 or 1099 because it comes from the IRS. The only additional thing you need with transcripts is proof of your joint sponsor's US immigration status. If a US citizen, then photocopies of

--joint sponsor's birth certificate showing US born OR

--US passport biographical pages OR

--Naturalization certificate

If a greencard holder, then

--photocopy of greencard

Please note:Also since you live with the MIL who did the I-864A, there should be some proof sent that MIL and wife live in the same house--like driver's licenses if same address is not on their tax transcripts. And proof that they are related for example wife's birth certificate which would list her mother's name. That's on page 2, Number 8 of the I-864A Instructions. Did you send all that before??

Sorry if I'm repeating things you know. I'm listing all this stuff to check because you never actually copied word for word what your RFE said. Many people think they know what it's asking for, but don't interpret it correctly. You thought you got it right the first time, so you for sure need to get it right the second time.

Okay so yes. Obtain tax transcripts. You technically only the info for the last tax year (2010) but I would apply for all three. They're free. Follow the guide from Nich-Nick on how to apply for them. I called and had them faxed. You can also have them mailed. Or you can go into an IRS office and pick them up. The person who's transcripts they are will need to call/go in to get them.
