So we got an RFE letter in, on xmas eve none the less! Didn't even know it was there till xmas morning. Nice first xmas with my wife, THANKS USCIS!

The letter is simple yet confusing. We followed the instructions for the affidavit (page 8) to the letter and I have a copy of everything we sent. The only thing they're asking us to resubmit is the tax returns (W2's and 1099's) on form I-864 for my wife WHICH WE DID the first time around. And, the income tax returns for I-864A for my mother in law which we DID the first time round I have the copies sitting in front of me. The only thing I can think that would be the problem is that they were electronic, we printed them off, but my wife files online so hers ARE electronic. We plan to phone them in the morning and double check but can anyone shed some light on this??

I really want my EAD through so I can start pulling my weight money wise, my wife doesn't care but I do, I want to share the load and this has put hold on processing.

Also is my biometrics still a go?? it's coming up soon!

Safe bet is to have your wife and mother in law request tax transcripts, I received mine within two weeks. Bio metrics should go on as planned, picture taking and finger prints. Don't be surprised if you get a letter after bio metrics requesting an interview. Don't worry bring a few pics, joint bank account statement, insurance card, anything that shows both your names in it. They even asked for my Birth Certificate(Petitioner). I could be jumping the gun so just fix your Rfe with the transcript, then wait for approval or interview letter.

From USCIS--

Note: IRS permits and encourages electronic filing of Forms 1040, 1040A and 1040EZ. An electronically filed tax return may also be signed electronically. When a person signs and files the tax return electronically, a hard copy of the original tax return will not exist.
In this situation, it is acceptable for the person to submit a plain copy printout, showing the tax return as it would have looked, had it been filed on paper, together with the IRS-issued declaration control number.
By signing the Form I-864 or I-864A under penalty of perjury, the person certifies that the copy is a copy of what was submitted to IRS. As with paper-filed returns, it is also acceptable for the person to submit an IRS transcript of the electronically filed return.

I'm wondering if you submitted a copy that looks exactly like a paper return would look....1040/1040A/1040EZ plus any Schedules like SCHED A/SCHED B/SCHED D plus W2s and/or 1099s. An IRS transcript will solve your RFE problem if you don't know what a tax return should look like.

I wish I'd have just got the transcripts first. I had an RFE about the tax forms after waiting about 80 days from my initial filing!

Now I have to wait another 2 weeks or so for them to send back the tax transcripts, then I have to mail them to the USCIS office, then I have to wait for them to process my EAD, which they said can take up to another 90 days (I REALLY hope it's not that long). Then I might finally get my EAD after 3 and a half or 4 months or so :|

All this and I already have an assured job offer waiting for me... and waiting.. and waiting..

I'm not very knowledgeable about tax returns being from the Uk and all, but luckily my mother in law is and is taking a look at your reply. At first impression she's adamant that that's what we've sent... We'll deliberate and decide the best move but transcripts might be our only option lest we risk another RFE.

That's horrible mate, find myself in the mirror situation that you're in, I don't have an absolute job set but a pretty good chance. Seems like the only thing I complain about is being able to pursue work and in turn driving, and independence through integration with the banking system, aka money! Annnnnnd it's the only thing I have problems with. Brilliant way to start the new year.

Four ways to order. I've used all four and with good results

  1. If you have a fax machine they will fax the transcripts same day. Call them and speak to a person. 1-800-829-1040
  2. Online ordering is here http://www.irs.gov/individuals/article/0,,id=232168,00.html
  3. Automated phone ordering 800-908-9946. Follow prompts.
  4. Mail or fax in request paper form http://www.irs.gov/pub/irs-pdf/f4506t.pdf

#2 and #3 you receive by mail at the last address they have on you. If anybody has moved since filing the 2010 return, then those won't work.

another vote for tax transcripts! they are free, fast, and just one (or two?) sheets of paper so they dont fatten up your application with extraneous pages to annoy the adjudicator!

They won't RFE you for the same thing a second time. They'll DENY you. There really is no "deliberate" choice. Contact the IRS and get the transcripts. Its the only way to be 100% sure you've submitted what was required.

Timeline

Tax transcripts are fast and easy. I was worried about leaving something out, so I just went the transcript route and had no problems. I don´t know for sure, but I doubt it would take another 3 months for the EAD. It seems like pretty quick after receiving your response to the RFE, they will resume processing your case. Good luck!
