It appears you are tying to spin or interpret what the notice says. If they are sending it back to USCIS, then the visa has been denied. See my earlier post. Yes, it is irrelevant that they did not stamp his passport. They don't do ANYTHING to the passport when denying a visa. What you need is an actual copy of the notice your fiance was given. When you read it and interpret it literally instead of "favorably" you'll understand that what I told you earlier is correct.

Look I dont need your negative feed back. You're not familiar with the way things are done at the Jamaican embassy. I wasnt there at the interview I'm repeating what I was told by my fiance. OK so I would APPRECIATE if you dont add your two cents in this. Thanks

Although many embassy's do SOME things differently, they ALL must ensure that there is a solid bonafide relationship. Your fiance failed to prove this. He was denied. To have the CO ask him to write your name 3 times, in my opinion, tells me that the CO had some serious concerns. Sorry that this happened, but he was not prepared and should have been and this is something both of you should have taken care of before his interview. Not to mention, because he was rescheduled, you had even more time to...download photos from a phone.? Sorry, but this shows lack of concern.

To have the CO ask him to write your name 3 times, in my opinion, tells me that the CO had some serious concerns. I feel bad for this lady because this situation sounds like the fiancee (beneficiary) didn't take this seriously. The photos answer was a lame excuse.

Don't ever do anything you're not willing to explain the paramedics.

I am confuse with the statement you keep stating if denied, they would stamp his passport. I have never heard of that being the case at the Jamaican embassy. I am sorry to say, it does sound like a hard denial.

He is mistaken, alas.

If they were going to do additional processing at the Embassy IV unit, they would have told him so. They may or may not have kept his passport, as well. If they did not keep his passport, he would have gotten another 'sheet' of stuff, requesting additional information to be sent in, along with his passport.

He didn't receive that.

He received a 'hard denial', instead, with a sheet containing verbiage stating that the casefile is being sent back to the USA for possible revocation.

Right?

Way back in post #6, I was trying to 'get you' to 'get' your fiance to send in an exact copy, a scan, of all documents he was given. You really should get them, study them, todayish. Removes a lot of conjecture and doubt, all the way round.

PS - there is no Jamaican Embassy in Jamaica. Same way there is no US Embassy in USA.

My fiance went on his interview on Friday. After providing his proof of relationship, Immigration Officer asked him for more proof. My fiance asked him what more proof can he give? He had phone records, Western Union receipts, Pcitures, Letters, and Proof of my last visit in July. The Immigration Officer asked him why didnt I come back after July? He told the immigration officer because I started a new job and couldnt get the time off from work. So the immigration officer told him that they will have to conduct a background check on me for more evidence. They handed him a white sheet stating that enough evidence wasnt presented to believe that we were in a legitimate relationship. The officer told him that after they do a background check on me they will call him back and make sure he doesnt lose the paper because he will have to bring it back with him to the embassy when they call him back. I am totally confused. Is this the Ap process or what? Was he denied or what? I was told usually when a person is denied their passport is stamped. His passport wasnt stamped and my fiance said during the interview they fingerprinted him. Please somebody let me know what this means.

The file is being sent to USCIS means your visa is denied. It doesn't matter whether or not his passport was stamped "Denied" as he probably was looking to see. You'll be notified by USCIS once they're in receipt of the file. Once the reason for the denial is clearly stated by USCIS in their letter to you (the petitioner), you'll be able to gather enough evidence to possibly overcome the whatever reason - not guaranteed, though.

Well actually from my fiance reading the paper out to me. It states they will send the petition back to the USCIS which means that everything is going down the drain.

Is it possible the visa denial has something to do with what you wrote 60 days ago? Did you take action to cancel the petition? Was the Consular Officer aware of the arrest or your intention to cancel the petition?

I cancelled my petition because I've learned that he was charged for rape and indecent behavior. Thank God I dodged a bullet. Hope his #### rots in jail. Next time I wont be so hasty. You really have to get to know a person before making such a drastic step. i feel very relieved.
