Anyone has applied both I-130 and I-129F ?

Hello and happy holidays,

I have a question about K-3 Visa(I-129F) process, since I already started I-130 process for IR1/CR1, can

anyone recommend to start K-3 Visa(I-129F) process at the same time so if I-129F approve first then

spouse can get at least come to USA to process immigrant visa.

Anyone has applied both I-130 and I-129F ?

Why recommend you do the K-3?? That would just be mean!

It costs more, takes longer and you do not get a green card on entry.

The CR-1 is cheaper can be faster and you get a green card on entry.

If you file the I-129F to start the K3 path, USCIS will tie the two petitions together. They do this by pulling your I-130 from its current place in the queue and placing it with the I-129F you would have just filed. The two petitions are usually adjudicated and a decision made on them at the same time. If both are approved, they are sent to the NVC. If the two petitions arrive at the NVC at the same time or if the I-130 arrives at the NVC first, the I-129F will be administratively closed by the NVC leaving only the I-130 active. If the I-129F arrives first, that petition will go forward (although you will have a choice as to which path you ultimately wish to pursue).

Since the majority of I-129F petitions filed in conjunction with an I-130 for a K3 visa end up being administratively closed, your best course of action (in my opinion) is to let the I-130 run its course as a standalone.

Exactly. I would simply add that even when the K3 visa was still a viable path, (before the current NVC policy began two years ago) it hasn't saved any time since late 2006.

What I don't get with USCIS and Consulate processes is that if USCIS approved your petition and Embassy can deny your petition if they feels that you are not credible in your interview. What's the point of going through the appeal if USICS can approve and Embassy can deny the visa?

You can file both forms but sometimes USCIS will approve the family visa petition and reject the fiance visa petition or vice versa. It is good to do both because it will increase your chance of approval if they rejects one form and approves the other form.

Filing an I-129F for a spouse does not increase your chances of obtaining a visa. The I-129F will simply be administratively closed when it arrives at NVC. Only the I-130 will arrive at a Consulate or Embassy abroad. Take it to the bank. Really. Not our first rodeo here, OK.
