We received approval of our I-130 the middle of December and it was sent to the NVC for further processing. We expect to here from them within the next 30 days.

I plan to file my 2011 taxes in late January. I will file married filing jointly with my new spouse. She does not have SSN or ITIN yet. I was advised to just put in the placed where her SSN should go "ITIN APPLIED FOR". I will send the 1040 along with W-2's, 1099's, her original passport, to Angeles City in the Philippines where a copy of her passport will be certified and then the package will be forwarded to the IRS in the States. This process will take about 5 to 6 weeks before IRS has officially assigned an ITIN and accepted (hopefully) our tax returns.

My question is, can I send a copy of the 1040, W-2's, 1099's, passport certification to the NVC at the same time that they are sent to IRS in late January, or should I wait until I have received word from IRS (refund due) and the ITIN has been assigned before I send the I-864 to the NVC?

you need to down load a w-7 form from the IRS.gov you both need to sign it. a copy of your marriage, and id.you will need the itin number for your wife to put on your joint return 1040. the department that handles that is in auston texas when you get your itin number an ready to send your taxes in it must go to auston taxes,irs. wait until you receive the itin number, read the instructions on the w-7 carefully.

I'm well aware of the requirement for a W-7, already got it filled out. It will go to the only office in Asia which can certify the passport and do whatever they do to the W-7. The SS office is located in Angeles City, Philippines. I've already communicated with them. If I send the joint taxes (ready for filing), W-7, my wife's original passport along with a color copy to be certified, they will mail the entire package to Texas for me. I talked to them on the phone, they done this thousands of times over the years.

My question was should I wait until my wife get's an ITIN until I send the taxes to the NVC?

FWIW,

I wouldn't worry about needing 2011's tax return for the NVC or embassy unless your guy's interview is past April 15th. (just have it ready for the interview just in case unless you are worried about meeting the poverty line in your 2010 tax return) When I sent my tax transcripts we weren't filed married joint because we got married in august 2009. My wife's interview was 15 April 2010 and they didn't care about the current year's taxes (although I did supply the current year's W-2s in the package to the NVC and to my wife). The whole ITIN thing is kinda of a pain in the butt...although, you don't need to use the passport...there are other forms of ID that you can use and get authenticated. I got caught up on the passport thing too...there are other ways to show eligibility.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

No need to wait. Your plan will work perfectly as is. NVC doesn't need her SS# or ITIN.

I know you can use things for ID other than the passport, but if you don't use the passport, I believe you have to have two other forms of ID, the passport is sort of like aa trump card, it's the best thing to use.

I want to use 2011 taxes as 2010 taxes were filed jointly with my ex and I just don't want to open up that can of worms. I'd rather wait a few weeks if I have to so I can use 2011 taxes to show I have enough income to support my wife.

That's not correct.

I had applied for my wife's ITN number a few months ago in preparation of filing my 2011 taxes. The request was denied because I didn't supply the tax return.

I was confused, what tax return I haven't done it yet? so after many hours trying to get through to them. I found out we need certified copies of her passport and marriage license (proof of identity), the W-7 and 1040(x) you are filing as well as a letter from her telling the IRS that she wants to be considered a resident alien for tax filing purposes for 2011.

This came from the IRS legal department who helped me.

They tell you that it will be delayed if your submit it during the busy season, but they won't allow you to do it outside of filing your tax return so of course its the busy season.

What are they doing all year long in outside of the 3-5 months of tax season????

10-16-10 Meet her parents and family in the province for the first time

10-25-10 Returned to States

11-2010 Started her annulment process

1-4-11 Free to marry within the country

2-8-11 3rd trip to Philippines

2-10-11 Annulment process complete (can file for US visas now)

4-27-11 Got Married

5-30-11 Finally received marriage contract from priest

6-4-11 Discovered we needed to get an electronic endorsement of our marriage contract submitted

6-22-11 Finally got updated CENOMAR to show annulment of previous marriage

7-29-11 Finally had to say good bye and leave the Philippines after 6 months

8-18-11 Submitted CR-1 pkg to visa service agency

9-9-11 After a thorough review and obtaining additional docs, finally mailed our pkg to USCIS.

9-12-11 NOA1 received

3-14-12 USCIS approved our I-130

3-17-12 NOA2 received

NVC:

3-19-12 Package acknowledged by NVC.

4-3-12 NVC enters our package into their system and generates our case#

4-4-12 AOS pmt made

Manila Embassy

4-9-12 Petition US Embassy Manila to expedite since I will be in country

5-23-12 Interview at US Embassy - approved

5-31-12 Visa in Hand

6-6-12 Len Arrives!!!!! in the US via Chicago to Houston
