Yes you can file after. But before you wait those 4-6 weeks up to 4 months for the cert. marriage certificate try stopping by your county clerk's office and ask if they'll make them there. It works that way some places(including the county/state I'm in, for a fee).

Congrats on approval :)

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

Click timeline or "about me" for all details.

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

This is absolutely the way to proceed, si man. Ask the officiant at your wedding if you can hand-carry the signed marriage license to the county clerk's office (or courthouse), explaining why if you're asked. This should not be a problem. Then, regardless of the cost, order multiple copies of the marriage certificate. You'll need them! I ordered 7 copies, which were made while we waited at $7 apiece. We ended up using 5 of them.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I have one and have only every used that one. Everyone takes copies of it, not originals. I've changed my name in Aus, passport, drivers licence, bank accounts, Centrelink stuff etc. In the US I've done the SSA, AOS, DMV, Bank and still, I have the original.

Be that as it may, our bank required an original, and we didn't get it back. The mothers-in-law may want a souvenir, too.

It's always good to have more than one original copy that you can immediately lay your hands on. Better to have an extra original than to need one (perhaps urgently) and not be able to provide it.

Hey guys,

My fiancé is coming to america from Philippines on Dec 27, 2011.

Our wedding is on Feb 12, 2012. It takes 4-6 weeks to even 4 months to RECIEVE a certified marriage certificate. Do we need to file the AOS before 90 days expiration with the copy of the certified marriage certificate?

No.

You may find you can get the certificate faster if you go to pick it up yourself or theur may be other ways which you can cut that time if you do a little legwork. Ask the county clerk or whoever issues the marriage lisence.

We took the official, signed, marriage license to the town clerk after our wedding and said "we'll wait while you do the certificate" We got married on Friday and had the certificate in hand on Monday morning. Had we allowed the officaint to mail it, it would have been "2-3 weeks"

However, there is NO deadline for filing the AOS only for getting married.

VERMONT! I Reject Your Reality...and Substitute My Own!

I got married in Hawaii last April 19 and I received my certified copy thru mail around 23rd of May and was able to file AOS 5th of June.

We did informed our marriage officiate that we are K-1 and has to file AOS, the officiate went to the Dept. of Health right after the wedding to turn over the signed marriage license. The next day, we went to the Dept. of Health to request copies (5 of them) which we received on the 23rd of May.

Ok... I'll do the same. I'll ask the marriage officiate our situation and that we would need several copies asap.

You do not need to do it within 90 days. But the sooner the better for her ability to work etc.

You can get the rest of the packet ready to go and just insert the certificate when you get it. We got our certificate 2 hours after we were married but didn't file until about 6 weeks after the date on my I-94. No problems.

05-2010 I-129F application received by USCIS.

05-2010 NOA1 received.

07-2010 NOA2 received.

07-2010 Packet 3 received.

08-2010 Packet 3 returned.

09-2010 Medical in London.

10-2010 Interview at US Embassy in London: Approved.

10-2010 POE Newark, NJ.

11-2010 Married in Vermont.

03-2011 Notice of acceptance of AOS packet.

03-2011 Biometrics appointment in St Albans.

03-2010 Case transfered to California Service Centre.

04-2011 I-485 Approved.

The answer is "No". It's ok as long as you get married within 90 days of your POE. At the interview, IO asked me whether I got married within that 90 days or not.

For us , we got married at county city hall after 2 weeks of my arrival in the States as we will make reception in our home country. So, we got the certificate on the spot and we filed AOS 2 weeks after our marriage.
