Hi,

I just received tax return receipts from the IRS. Are these receipts acceptable for filing forms?

Or will they want all the paperwork for my tax returns. The ones that I received are only a page worth of information

If they are tax return transcripts that you ordered from the IRS, then yes you can use them. If not then you need to either order them or find all pages of your taxes + W2s and any other additional papers filed with your taxes.

When we ordered ours and got the transcripts in the mail it said right on the first page that they are tax transcripts that were ordered by us etc and then it was 2-3 pages of information.

Look at the top of the page. Does it say "Tax Return Transcript", "Tax Account Transcript", or "Record of Account"? A Tax Return Transcript is preferred. A Tax Account Transcript won't be accepted. A Record of Account is a combined Tax Return Transcript and Tax Account Transcript, and is acceptable.

If you submit a Tax Return Transcript or Record of Account then you won't need to submit any of your original tax return documents.

The bolded above is wrong. That is what we submitted and it was accepted no problem. All the other people people I know that also submitted the account transcripts had no issues. It's smaller and shows whether any amendments have been made since the return was filed. There's nothing wrong with it.

I'm sorry, but I don't believe this is good advice. The I-864 clearly states that the income that will be considered is the "total income" from the tax return. A tax account transcript lists adjusted gross income and taxable income, but does not list total income.

Getting down off my high horse now...

Ok, any rational person would know that if the AGI is sufficient to qualify then the total income must be sufficient to qualify because it's going to be equal or greater than the AGI. Your experience obviously shows that they'll accept a tax account transcript if it clearly shows there's ample headroom in the income for the sponsor to qualify. However, some people are close to the margins. They might have a total income which is sufficient, but an AGI which is not because of exemptions. Their affidavit of support might be rejected as insufficient if they sent a tax account transcript when it might have been accepted if they'd sent a tax return transcript. The key piece of information they need is on the tax return transcript, and not on the tax account transcript.

Unfortunately, there is no clarification from USCIS about this. The AFM says:

A sponsor may submit an IRS-issued transcript instead of a photocopy of the sponsor’s tax return. A sponsor may obtain a transcript by filing IRS Form 4506-T with the IRS. Currently, the IRS does not charge a fee for transcripts. Tax transcripts provide proof that the returns were filed with IRS, are easier to read, take up less room in the file, and are easily obtained. If a sponsor submits a transcript rather than a photocopy of the tax return, it is not necessary for the sponsor to include copies of any Forms W-2 or 1099.

So they only say "transcript", but don't specify what kind of transcript they want. However, I will concede that it was wrong of me to say a tax account transcript won't be accepted because it was obviously accepted in your case.

Peace? (F)
