okay so my fiance has been down to the the states in intervals that equal up to about 150 days within the last year...

and if im correct when he is down here he can only be down here for 180 days in one calender year if im right.

and i dont want to be apart during the whole duration of the k1 visa, and i want him to stay with me for a few months until his interview.

so im wondering if its okay that he do that? or will that reject him of a visa due to him spending too much time in the states... im very confused...

please help!!!

December 2009 -- Visit to Malaysia.

February 2010 -- Applied for B2 visa, approved.

March 2010 -- Visited US.

April 2010 -- Returned from US.

May 2010 -- Sent in K1 Visa application.

July 2010 -- Received NOA2 in 71 days from NOA1.

July 2010 -- Packet 3 received.

August 2010 -- Cancellation of K1 Visa application.

Oh, you haven't filed yet? I suggest that he visits you for less than 30 days during the K1 process (since he has already been in the US for 150 days), but he has to be in Canada for the interview... so perhaps you can be with him in Canada for that?

Oh, you haven't filed yet? I suggest that he visits you for less than 30 days during the K1 process (since he has already been in the US for 150 days), but he has to be in Canada for the interview... so perhaps you can be with him in Canada for that?

Earlier I said this: "I suggest that he visits you for less than 30 days during the K1 process"...

So that means he can visit, just for less than 30 days :yes:

I am not entirely sure but I don't think it's a good idea to stay for more than 180 days in a year. Someone will correct me if I am wrong.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

This question would do better if posted in the Canada sub-forum. I have read of Benificaries from Canada & UK coming for visits during the K-1 process but I have also read of some being turned away if they do not show strong ties to return to respective countries.

Anyone can report. If it is a TOS violation, duplicate or clearly in the wrong forum (K1 question in CR-1 forum etc), we will always delete/move/merge. If it is questionable (say, a question about attending college after K1 entry posted in AOS forum, that might suit Moving here or Working during Immigration forum better), we will generally only move it per OP request.

There's no rule about staying 30 days, unless his I-94 specifically dates his expiration date as 30 days. Do NOT overstay that date.

The issue you may have is when the IO reviews how many times your fiance has been in/out of the U.S. during the year. If it looks like your fiance is attempting to live in the U.S. (which may be considered as spending more days per year in the U.S. than in Canada) it may look suspicious. Proof of ties to Canada, return information, etc should be brought - but it should be brought regardless as entry is never guaranteed anyway.
