Visiting US while I130 is pending

Hi.

I'm still waiting for my NOA2 and should be getting it sometime in Jan. My question is that can my wife come here on visiting visa? is that process quick to get the visa and will they let you in while you are trying to get the CR1. It just seems like that this process will take until april or may and i wanted to know if she can come here on visitors visa...in feb?

I asked the same question on this site and they told me that they wont issue a visiting visa if you already started the I130 process... So I guess we just have to keep waiting..

USCIS STAGE

8/22/2011: NOA1 EMAIL(never received a hardcopy nor txt)

3/23/2012: NOA2 EMAIL!!!! :D

3/28/2012: NOA2 HARDCOPY

NVC STAGE

4/09/2012: NVC Recieved

4/24/2012: Got NVC Case# and Invoice ID#

4/25/2012: Sent DS-3032 email and Paid AOS fee

4/26/2012: AOS fee showed "paid"

5/2/2012: Sent AOS Package and NVC accepted DS-3032 email

5/4/2012: Received and Paid IV fee

5/7/2012: Sent IV Package

5/14/2012: Case Complete at NVC!

6/6/2012: NVC Left!!

Beirut Lebanon Consulate

7/11/2012: Interview!!

Result: My husband is put in Administrative processing :(

8/17/2012: Embassy called my husband to bring the pasport for the visa!! :D

Highest reason to be denied a tourist visas -

1, married to an american

2, showing you have intent to immigrate to the USA ( filing a spousal immigration petition or other immigration petition)

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

The only case I know first-hand for someone coming from a non-waiver country with a pending I-130 did this by booking an air ticket this month to Mexico with a stopover in Los Angeles was successful in getting a transit visa for ~36 hours. This will allow them to leave LAX terminal on christmas day, enjoy time with family in the LA area and then board the flight the next day for a quick holiday in Mexico before heading home.

This is, at best, a gamble as the US consulate worker has absolute discretion in approving your transit visa. There is a chance of approval. There is a chance of denial. If denied, you have an air ticket in your hand you can't use.

I was thinking of visiting my brother in Montego Bay, Jamaica, with a stopover at LAX, thereby being able to spend at least a coupla days with my husband. But then, if the VO decides against approving the transit visa, it'd be rather unfortunate!
