Hi All,

I am in the almost same situation as you guys but with some complications, I will try to be as brief possible here

Firstly I am looking for a very good Immigration Attorney as its been 2 (End February) that I was given the permanent residence in the US with the condition of being married to a US Citizen.

Unfortunately, when my wife and I got to the US things started changing specially with Her. I was working in the UK when she asked that we move to the US, I mean United States with no specific ... I work in a field which job can only be found in some area mainly such Silicon valley, Austin, Boston and some others ... My Wife and I were clearly aware that the town or State she was living in at the time we were processing the Immigration to the US does not offer possibility for me to work. Obviously this has been debated and as work around we agree that we open the options to move where we can both work

strangely enough the day I landed in the US at the airport, She told out of the blue (please tell me if that s true?) I quote: "... Now that you are in the US, let me tell you the laws here are in my favor"

Note: I am Black and she is white

Pretty quickly as I mentioned she changed completely in her behavior towards me arguing all the times, becoming my boss at Home rather than simply being a wife to her husband and me a husband to his wife ... there were some moment of hope but mainly moments of pains and disappointment... I have tried all avenues to find reconciliation , her requirement at some pint was that I completely give my career and stay home or work in a store

One during a marriage counseling session the counselor asked her when she makes such request is she willing to share her salary ? her answer was no

Things not getting better and before I loose my career with a deadlock situation , I took a job offer in California. she did not want to come or ask for transfer from St Louis to California. Note she has no family in St Louis

We have a child together, we are going through the divorce and Child custody (which battle is not looking good for me as the court refuse that my Son comes to spend time with me, the court(the GAl) refuse does not sanction her at all when she violates court order even with the proof and facts that i provide... that s another issue ... I am the one taken the financial burden

Anyway if anyone knows a really good Immigration Attorney please let me know i fair that my ex-wife wish is to have me deported so she can have the kid for alone

And perhaps some evidences that i can produce to the Immigration for my complicated situation ?

I have given here enough information so someone could guide me to the right

I'm not going to try and council you any more on this, cause i really (luckily) have never been in a situation like the one you describes, so good advise from me would probably not cut it.

Therefore i'll only respond to one of you questions:

Do i know a really good Immigration lawyer?

I had a very good experience with a San Francisco based Immigration lawyer. While my case was pretty vanilla, i don't think i have actually asked him to defend a challenging situation though, so i'm not sure how he would do in "difficult cases".

However, feel free to look at some of his reviews on yelp, his website and decide if you want to drop him a mail, give him a call.

Hi! I'm really sorry to hear about your situation with your wife :( I'm not familiar with how to file the I-751 with a waiver due to divorce so you might be able to get more help if you post a new topic (you can start a new topic here http://www.visajourney.com/forums/index.php?app=forums&module=post&section=post&do=new_post&f=86 ) so someone with a similar situation would be able to help. I do know that the USCIS will definitely be looking for evidence that you entered into the marriage in good faith. I believe that proof that you went to marriage counseling will definitely help. Did you have any joint bank accounts or credit cards? Did you file any joint tax returns? Those would really help too. You can also include your son's birth certificate and any proof you have that you were involved in his life (parent slips that you signed, letters from teachers, stuff like that?).

I am excited, too, for us January filers to start receiving our biometrics appointment letters.

I remember getting one for AOS less than half a month after submitting the I-485. How I hope that the whole I-751 processing will be as fast, if not faster than the I-485 period!

Didn't add any affidavits, we think we have enough evidences and we will send them if we get RFE.

I have submitted my package for my wife through normal mail to VSC on January 9th, Receipt date is the 10th of January, Checked cashed on January 12 received NOA Friday January, 13th. Hope the rest goes this quick, but from seeing most timelines looks like biometerics in a month or two and Card in 6 to 7 months. IF all goes well of course. Just glad to get the NOA back so quickly. Can I be added to your list? Also it says nothing about the step daughter, do they normally just send one NOA and as far as the case is concerned process both? I assume so but it doesn't say her card is extended or even have the daughter's name on the NOA. Can anyone elaborate on that? Haven't read to many people having problems and I dont anticipate any but would be nice to hear if anyone has ROC'd for step children. Thanks and good luck all..

Also hard to believe that two years ago I was collecting and traveling throughout Canada to get them into the states and now Im getting set to get a Permanent card. It will be nice to not have to worry about it for ten years. Although Ill see about citizenship but I am in no rush.

The NOA1 dates we are listing are actually the receipt dates on the notice :) Our NOA1 date was Jan. 5th but we didn't get the notice in the mail until Jan. 12th ;) ) checked the postmark and they actually mailed out the notice on the 9th. ^_^ Yours should be on its way! ^___^

I actually sent mine out on the 9th or 10th they cashed the check on the 12th, and got the NOA on the 13th. So I guess its pretty quick through VSC... so yea i guess pretty quickly. From all the timelines i have been seeing people have been getting them back within 2 weeks.
