Hello, I would like to know if anyone has experience getting an extension on a USCIS approval date. We jumped thru all the hoops, (hired a lawyer, paid all fees, got all the forms done, have tons of evidence, no police record on either of us, clean health record, etc.- a very clean simple case.) and were denied a K-1 VISA at my fiances interview in Lagos Nigeria on Nov.21st 2011. Our USCIS approval was good until Dec. 8th. We have been fighting to get a motion to reconsider or a reopening of our case at the consular level, but meanwhile our approval has expired. We have talked to everyone about both getting the date extended, and getting a reopening, and haven't had much success. They seem to want us to reapply. I fail to see the sense in that. If the consulate is sure that our marriage is "for immigration purposes only" (basically scamming) as it states on the denial, then I suppose that next year after we pay thier fees, and redo everything they we wont be scammers any more??? This denial is going to make things very difficult for us, even though they try to tell me that it wont. Anyway, I just want to know if anyone has gotten the USCIS to extend an approval date. Thanks!!

sorry to hear that. I have not heard nor read anyone getting an extension not even on USCIS website then again a new policy may have been implemented. Most people just refile and try to provide more vidence( dont know how much you guys presented during the first interview. some others just get married and do a K-3/CR-1/IR-1.

Hope it works out for you both.

Once the petition is in the embassy hands and the interview took place there is no more extending the petition. You are now at the mercy of the Embassy and your local office. California is the office most apt to declare the petition dead and tell you that you can refile. Lagos is a huge cash cow for immigration. They collect fees from thousands of hopefulls and rarely deliver anything ( we have all seen the lines of unhappy people leaving the embassy ) There is a small chance that the petition will be reaffirmed. However because the K1 is expired you really don't have to wait on anything. If you know how to repair the filing you are free to file again right now. Just include a cover letter that states your first petition has expired and you are free to file today

This will not be over quickly. You will not enjoy this.
