Hey all, I wanted to let you guys know that along with LOTS of prayer, we called both the senators in our state, and about 3 days after the first one contacted the USCIS office we got a response, approved February 15th. Our filing date was August 10th. So if you think it might help, call your senator when you pass the 5 month mark, and keep praying.

After watching lots of applications filed after mine get approved, I broke down and called my senators and congressman. Weirdly though, I got an email from my congressman today saying that he called the service center and was told that our I-130 application was approved yesterday. However... the website still says we're in initial review.

I called USCIS about this discrepancy, and they had no idea what was going on. A woman at USCIS told me the following things through the course of the phone call:

1. It hasn't been approved.

2. Maybe it's been approved, but it takes a while (up to a month?!) to enter it into the computer system.

3. Our service request was cancelled yesterday, indicating possible approval.

4. It's on its way to NVC, so that means it must have been approved.

I have no idea how to feel about any of this. Any ideas?

Well, we complete six months since our NOA1 today. Since calling USCIS hasn't been very helpful, my husband's gotten in touch with his congressman to look into the matter. Let's hope we hear from them soon.

The USCIS Trend Chart gives an idea of what happened to all the July and August filers.

In June and July CSC was ripping through the I-130s and were approving far more petitions than they received. In April '11 they had 101,000 I-130s pending, by the end of July they only had 72,000 pending. They were approving 23,000 - 28,000 petitions a month from May - July, while only receiving 16,000 - 20,000 in those months.

Then.. Something happened in August:

August '11, CSC received 20,000 new I-130s but completed only 15,000.

September '11 they received 18,000 I-130s but only completed about 14,000.

October '11 they received 18,000 new I-130s but only completed 12,000.

And get this, in November '11 they received another 18,000 new I-130s and completed only 10,000!

From August until November, they received on average 5750 MORE petitions each month than they managed to complete. Their total number of pending I-130 petitions went up from 72,000 in July to 103,000 in November!!

They don't have any updates beyond November (They're supposed to update monthly), so there is no telling what happened in December, January and February.

but their numbers for August - November are almost scary. No wonder June and July filers had to wait 7 months.

They must have been happy with their July rates, so much so that I suspect they pulled half their work force from doing I-130s and had them do other types of petitions.

Here's the good news I can gather from this:

If you look at the trend chart dating back to December '09, their number of pending I-130s range from 70,000 to 120,000 for any given month. It also seems like they tend to hit a peak around 105,000 pending petitions in which they seem to say "enough is enough" and then try to speed things up drastically. I'm guessing they move people around from doing different petitions. If I'm right, CSC should have been moving people from doing other petitions over to I-130s to handle the massive backlog. This means that October, November and December filers should get their NOA2s faster than our poor June, July and August filers did.

For my part, I really hope this holds true also for January and February filers.

Again, this is guesstimation from my part. It's impossible to really say anything too concrete when USCIS haven't even updated their numbers for December, January and February yet..

For those lucky enough to have gotten VSC, it seems VSC is keeping a steady rate of receiving and approving the same amount of petitions each month, with little to no backlog since April '11. Meaning roughly for each I-130 received, they approve one.. That's why some VSC filers have received their NOA2s in as little as 2 - 3 months.

Keep your head up, they're pumping out August filers now. They'll speed up once October petitions are reached. CSC has been slow before. July filers in 2010 waited 6-7 months too, while December filers in 2010 "only" waited 4 - 5. Point being, the current processing times aren't here to stay :)

There are lots of lingering late July filers who are still in the last leg of their approval journey. Do you think this week perhaps they will be marked off the list.
